Hi Declan, not sure if you're still active here.. but I have a question and thought I'd ask, all the same. It's a bit of a tricky one. I'm a domestic gas engineer, employed 5 years. Q. Around 5 January 2023, I revealed to my company's HR officer that my line manager had unlawfully deducted my wage because I did not drive a company vehicle in the dark in sub zero temperatures with one headlight. The wording I used was that "he punished me for not driving my company van illegally". He was effectively coaching me to operate company vehicles regardless of their suitability for the road. I understand his action breached reg 40 A of the Road Traffic Act 1988. So I was effectively disclosing to the company that my line manager had breached criminal law.. and I was also highlighting latent danger (to individuals).. and that by disclosing this I may have 'blown the whistle'? About 3 weeks after I disclosed this, my line manager, without any prior informal discussion, asked HR to raise formal disciplinary action against me because I refused to fit a part to a boiler during a weekend standby shift. I asserted that I was following a strenuously stated departmental procedure (that we absolutely do not fit parts on weekend standby.. unless pre-approved by management). It went to hearing and I produced company emails which proved my case and both allegations against me were rejected; no further action. Unfortunately, I didn't know about time limits and so missed the opportunity to go to employment tribunal for.. breach of contract or whatever. It's multi-faceted and there's lots you don't know. However, 2 months ago I submitted a DSAR and only today was I able to collect the requested data. I've found an email from my line manager to HR relating to the matter of the disciplinary he raised against me, in which he states to her that he is "looking to go for gross misconduct". Her response is compliant. I had an unblemished record at that point. Gross misconduct for refusing to do a job only after I exhausted the available options.. and this was known!? My question is this - If I did indeed 'blow the whistle'.. could my line managers attempt to pin gross misconduct on me a few weeks later represent a "detriment".. and does the fact I only found out about his bid to pin gross misconduct on me today, effectively restart the clock?

Hi Declan, hope you’re well. Would making a disclosure directly to a tribunal itself constitute a protected disclosure? So, let’s say you made an initial disclosure to a government minister about a matter but it was passed back to your employer to address - a government department - and they responded to you. Now let’s say you later discovered that the response you received from your employer concerning those matters later proved to be falsehood that they told you knowingly. Would a subsequent disclosure, based on the deceptive response you received from your employer, be a protected disclosure of that subsequent disclosure was made to an Employment Tribunal itself? Also to bear in mind that there was no money sought at Tribunal therefore no prospect of financial gain? Also to bear in mind (and to complicate matters further) that the subsequent disclosure was made in breach of litigation or legal privilege? ie disclosing details of an ongoing case which demonstrated deceptions within the subject matter of the initial and subsequent disclosures?

Excellent breakdown. I have a question about witnesses statements not needing to have the truth statement prior to signature, can you ask the court Tribunal.....to strike out the statement especially if the witness has not put the truth statement at the end, and if they don't show up to be cross examined will this render the statement hearsay? There are fraudulent practices going on at the Employment Tribunal and the Appeal tribunal. All the cases are all managed to favour the employers. its all scammed and faked to favour the respondent. Don't dare take your case to the ET and AT, the judges are corrupt and they play script with respondent's barristers and solicitors to favour the Respondents. The judges are corrupt, dont dare take any of your case to them. its scary and shocking. Any pieces of evidence against the Respondent will be swept under the carpet, if you take it to a higher tribunal and complain about the corruption, the judge will condone it and sweep it under the carpet too. You either ignore your employer for maltreating you or dont dare take your complaint to the ET.
