Hello Sarah, First of all, thank you for your work. It really help a lot. I wanted to ask whether Ranjeev could not be a primary victim from the negligence for not maintaining the crane, thereby causing a breach of duty, which resulted from his severe pshiatric disorder, which is reasonably forseeable in case of a major accident, as happened. Thank you for your reply.

Hi Sarah, I appreciate this is an old video but I recently enrolled in an LLB and I am finding your content very helpful! When I first read the question, my immediate thought was that the college also had a duty of care given that Susan was a minor with no experience. I find it hard to believe that a 16 year old would have such a duty in this given scenario. Would really like to hear why this is not the case. Paul

Mullins v Richards says that children are compared to children of the same age. In a professional setting, somebody at the age of 16 would be compared to another 16-year-old learner. But of course Nettleship v Weston tells us that standards may rise but may not fall so a trainee childcare practitioner would have to be compared to a qualified to childcare practitioner.

They could be the defendant for the purposes of psychiatric injury but only towards a primary victim, it's hard to think of a scenario where it could be a secondary victim or rescuer

Could we have a claim for tort of negligence against the AA? They picked our vehicle up, put it on a truck to go home (2hrs) but then abandoned it half-hour up the road, at the side of the road. Then left it for two days, each time telling us it was being picked up in an hour or two, went on for 45 hours and the vehicle got smashed into, left somewhere we would never had left it. We got AA cover so a broken down vehicle was NOT left on a road. Now won’t take any responsibility for their negligence and liability. Beyond stressful and left us totally abandoned!!!

My videos are all based on the English and Welsh system . There are some differences with Scottish law so you'd need to consult a good quality textbook on the subject to be sure.
