Could we assume (based on USA v Nicaragua decision that invitation by rebels could not be considered a legitimate invite) that the support provided by Rwanda and Uganda on overthrowing the dictatorship by helping Laurent Kabila was in itself unlawful and an act of use of force?

I hadn't planned to. It was a poorly articulated, poorly argued attempt at an appeal in the Court of Appeal, which made no new law, and which did not even get over the time bar. All that really happened is that Mx Pusey (I use Mx because I believe they now identify as a Trans person but I am not certain) attempted to parrot submissions made by their own counsel in the earlier matter. From what I can tell they didn't even make the basic submissions necessary to have a conviction overturned on a plea of guilty. Ultimately it is an inconsequential judgment, which didn't live up to the bold predictions Pusey made while trolling this page some months ago. It really doesn't justify a casenote. All that needs to be said is this quote from the judgment: "It would be sincerely hoped that no person would ever engage in the outrageous and repulsive form of conduct indulged in by [Pusey]" I do think there is room for some level of empathy for Pusey, who seems to have unravelled financially, socially, emotionally and psychologically since the incident. While they present as being bold and angry and out to change the world, I suspect that they are simply experiencing an ongoing trauma reaction from the events of the night, and from their own poor conduct.

Despite "weathervaning" being the safest way to leave a crane to avoid it collapsing onto houses below if, for example, a strong wind sprung up and the crane arm was locked into position, it still has the capacity to cause anxiety to the people below. For those not familiar with the term "weathervaning", they should search "weather vane" in Google images. A weather vane spins to indicate the direction of the wind. Now, Google "crane collapse" and you'll understand the Plaintiff's anxiety.

Al-Kateb is now over ruled by the Highcourt in NZYQ of 2023 where the Highcourt departed from is Al-Kateb decision and determined that unless the Commonwealth is actively looking for another country for a detainee to be removed too, it is Unconstitutional to keep them in immigration detention.

That's almost correct; the HCA actually ruled in NZYQ that the specific provisions in the Migration Act were beyond the constitutional power of the Commonwealth Government in circumstances where there was no real prospect of the person being removed. However in this video, al-Kateb was not cited on the question of constitutionality of the provision; it was cited to show the enduring importance of habeas corpus. And given that the applicants in NZYQ were released on a writ of habeas corpus, NZYQ really just enhances the point I was making by citing al-Kateb. You'll appreciate I hope that an immense amount of work goes into these two hour videos, so I can't amend them every time the High Court changes its mind about stuff :-) Hopefully people will note the upload date and understand that the video represents the law as I understood it at that date.

In 1998 Britain passed the Human Rights Act. Article 8.1 says, "Everyone has the right to respect for his private and family life, his home and his correspondence." I'm not sure if this covers hospital patients.

Hi there, certainly the Human Rights Act has an impact, but rights of that nature are generally asserted against lawmakers. The HRA doesn't really imply that someone whose rights are infringed has a separate cause of action, almost a super-tort. I'm not sure that it overcomes the principle in Kaye v Robertson.

Hi Anthony, I’ve recently started a JD and have been very overwhelmed. As an educator I am shocked at the little prep they have for JD students and the introduction course is not enough. The change in style in writing and thinking is significant enough to have its own subject in many cases. All I kept think was that would make the job of reading student work a lot more enjoyable for the lecturers. I was unhappy with my performance but I know next term will be different. I learnt the hard way and wish I’d come across this vid, but watching this vid has made me more excited about next term. Thank you so much for your videos they have been such a treasure and you are an incredible educator and I’m grateful to have at least access to you online. 😊

No sir, international law may not be a law yet it is enforceable between the parties. Moreover, the jus cogens are never violated by ,almost, any state . There are a few states the independence of which is questionable or not accepted by many states. Therefore , based on their intransigence to the international law it cannot be said that it's out and out unenforceable. Lastly, I completely agree with your stance that it's not a law at all but this fact is not univerally acceptable too
