Hello sir.. my society did not charged non occupancy charges for past 3 years... I have paid all maintenance as per the maintenance bill on time Now they are asking to pay the NOC for past 3 years also Is it legal? Can I do anything about it?

Sir waht is the obligation of the Society while issueing the certificate - if the flat owner has taken a loan on the flat

This particular amendment has biggest loop/mistake, due to which society members are suffering in my society. Due to this amendment of allowing associate members to contest in election, makes associate member more powerful than any other fulltime members. How let me tell you, My society is in the process of redevelopment of society building and considering it as a good earning opportunity and it is been observed by few youngsters in society. They became the associate members, participated in society managing committee election and resulted in disaster. We have 8 associate members and 5 fulltime members in managing committee. cherry on the top is that the Chairman, Secretary and Treasurer, all are associate members. As a result, the society is struggling in the procedure of redevelopment since last 3 years. I would urge all the society, to take precautions in the election of Managing committee, if associate members are participating. 🤬😭😭😭🤬

Sir Thanks for the update. But one question, How an associate member (not a fulltime member) can become Committee member and becomes Bearer and signs all the legal papers of the Society like Share certificates of the members, Society Redevelopment legal papers (Development Agreement) etc..?

Hello Sir, section 159 a mentions concerned owners does it mean bot the upper and lower flat meaning the lower flat where the leakage is happening and the upper flat from whose bathroom leakage is happening

Rs.54500/-Unauthorised withdrawal charges included in my Maintenance Bill. I was not the signatory to the society bank account after May 2021. Neither society nor the CA are correcting my Bills. They are not providing proof of the withdrawal to me.

It is very surprising to know that none of the CHS experts on YT have made any video at all quoting case studies where how can the CHS recover legal fees incurred on account of the erring members who time and again have gone to quasi-legal & legal forums, have lied there and society had to defend their position despite no fault of the committee. Members who have more money than the society body can easily suck a society dry of its funds for their vested interests and I am so surprised that there is no video available on the matter. Pls make one.

Hello, if a society has 50 units and a member holds 3 units, then will the total number of members in the society be 50 members or 48 members (not counting the extra 2 flats owned by the member)

Limit for cash on hand in society Bye - Law 144 The Secretary of the Society or the paid employee, authorized by the Committee in that behalf, may retain in his personal custody, at the close of every day, a sum, not exceeding Rs. 5,000 (Rupees Five Thousand only),for petty expenses. If due to unavoidable circumstances, the cash in hand has exceeded the above limit, the excess cash shall be credited into the bank within the next three days by the Secretary or any other person authorized by the Committee to keep cash in hand.

Ye duniyabhar ke records maintain karne ke liye societies Manager appoint karte hai our Manager ke pichhe supervisor wala kaam laga dete hai. Year end me auditor ye record puchta hai to sab kaam adhura milta hai ourSociety wale bolte hai manager uska kaam thik se nahi karta.😂
