Great video! I had a question, if a beneficiary is owed x amount (say $20,000, according to the will), can the executor pay that beneficiary $19,970 to cover the $30 cost of processing a bank cheque, or does that bank cheque fee come out of the estate?

My mother in law told me that she went to her lawyer and rewrote her will, leaving my son her grandson her home and assets, her son was her POA,. She passed a few months ago and a woman claiming to be her lawyer because the original attorney retired is telling my son that they don't have a copy of the will. the POA wants to become executor and divide estate equally between 3 grandchildren. this is the questionable part. this new attorney states that my mother in law rewrote her will a third time dividing assets 3 ways, but she doesn't have a copy to show my son and this new will was supposedly rewritten while she was already placed in a nursing home because she had dementia. my mother in law explained to me that she rewrote her will leaving everything to her grandson because she didn't trust her son . she felt he would kick her grandson who lived with her, caring for her at the time would be kicked out of the house becoming homeless, she wanted to be sure her grandson would always have a home, so POA eventually sold the house to pay for her care, evicted her grandson and she passed 4 months later, and he hired an attorney and they say they have no copy of old will and wont show copy of new will that splits everything between all grandchildren. we dont know what direction to take. grandson cant afford attorneys fees, but something is shady.

Its been 20 months are we're still waiting for probate.

Thanks for the video - my father passed from Covid in Dec 2021, and his Will passes everything to my mother (who is also nominated as Executor on the Will). As the youngest son (I only have one other brother), I spoke with our family Solicitor & he said we do NOT need to go through probate and can do everything ourselves, to save money. I have so far successfully transferred everything across to my mother (Title Deeds, Bank Accts, Car Rego etc) EXCEPT for my father's shares because the Broker is asking for a Certified copy of Probate or Letters of Administration - do we STILL need to get one or the other ? Thanks for any help.

What happens if you are left a professional or business will and if that business has debt, does the beneficiary also inherit that debt - given that the business owner and the beneficiary did not have a legal general business partnership. What if you reject the will?
