Carl Schmitt was a Nazi. There is no way around it. His basic theme was how democracy is a sham because it always turns into dictatorship and a ruler, and also that the British (and Americans) had no right to criticize Nazi Germany because they were just as bad. He also wrote a book called Sea and Land in which he claimed that only land-based humans are real humans, but island-based peoples are "fish people." He literally used that term.

It is pointless to deny that Schmitt was a totalitarian. His commitment to majoritarian oppression is clear, and his invocation of democracy is merely an attempt to legitimize his rejection of popular sovereignty buffeted by judicial protection of civil liberties (aka: liberalism). What do you get when you mix Machiavellian amorality with the commitment to a "total state" couched in the tyranny of the majority? There is almost no person in history that better deserves the title of "fascist" than Schmitt. Sure, he wasn't totally committed to the Nazi party, but his contribution to fascist thought is undeniable. Late and post-modern Anglo-European philosophy (from Rosseau to Carl Schmitt to John Keane) is preoccupied with the rejection of popular sovereignty and the utter failure to reconcile civil libertarianism with positivism.
