Warri: Clarifying the Confusion There seems to be some confusion online about Warri, and I'd like to set the record straight. The Agbassa head chief isn't the first to be crowned in that enclave; I think he is the second or third to be crowned. Their status as tenants in Itsekiri lands cannot change, so do not be confused. As for the use of the Warri name in their coronation, we will respond to that legally or with a warning. Either way, his kingdom was created by the Delta State government under James Ibori, an Urhobo, in 2006, on historically and legally owned Itsekiri lands. The people he rules over occupy 7 settlements out of 68 communities in Warri, including Uboweagbassato (also known as Agbassa or Ubomale), Ogunu, Ukpokiti, Edjeba, Oteghele, and Ekurede-Urhobo. They call themselves Agbarha-Ame, a copy of their ancestral home in Ughelli called Agbarha-Otor, from which they migrated. He rules over the people in those settlements, but the lands in the settlements are Itsekiri lands under the Warri Kingdom. (See court judgments attached below). Here are some facts about the Agbassa people: - The Agbassa people are customary tenants to the Olu of Warri. - Agbassa land is under the overlordship of the Olu of Warri. (See Suit No. W/41/57, Suit No. W/121/57, Suits No. W/44/1941, and Suit No. W/3/1949). - Parliament did not at any time nullify the Supreme Court case against Agbassa or make the Ovie of Agbassa the overlord of Agbassa land. The Olu remains the overlord of Agbassa land. (See Suit No. W/41/57). - The court can deny the Agbassa people the right to occupy the land they are on under native law and custom if they fail to recognize the overlordship of the Olu of Warri. (See Suit No. W/44/1941, The Supreme Court in SC67/1971 & SC327/1972). - Agbassa land case is no longer on trial; it has been decided by the Nigeria Supreme Court and the British Privy Council as property of the Itsekiri. These judgments are final. (Ometa vs Chief Dore Numa 1934 11 N. L. R. 18, The Supreme Court in SC67/1971 & SC327/1972). - It was Ometa (Agbassa man) who appealed the Agbassa land case that they lost in the Supreme Court of Nigeria to the Privy Council in London, where he also lost, and the case was dismissed in favor of the Itsekiri. (Ometa vs Chief Dore Numa 1934 11 N. L. R. 18). - Judge Jackson, who decided the Sapele land case in favor of Okpe-Urhobo in 1941, also decided the Agbassa Warri case in favor of Itsekiri. (Warri A Focus on Itsekiri page XXIII and suit No. W/44/1941). Kingship does not determine ownership of land. Any group of people in Nigeria can form an association, including calling someone their king, but this does not mean they own the land they are on. This applies to the Agbassa people of Warri, who are and will remain customary tenants under the Olu of Warri forever. Changing the name of an area does not change the title and ownership of the land. A customary tenant will remain one forever. He is king over Urhobo people in the above-mentioned settlements but not the lands of those settlements. Just like there is an Igbo king in Ghana, who is called the king of the Igbo in Ghana, we all know the land that king resides on doesn't belong to him, so he is just there to rule the Igbo in that area or in Ghana, not to rule the land, as that land belongs to the people of Ghana. This is exactly the same situation. The Olu of Warri still remains the supreme ruler of all lands in Warri. I saw some posts sent to me where they claim “we own the city.” If they own it, their leaders should claim it by news conference or legal process. Their king cannot make claims of owning the land in which he resides, or else he will be sued for contempt of court. Being a king in a land doesn't necessarily make you the landowner. Whatever their followers say doesn't really matter; if they believe he owns the land, they should film their leader while he sits down and makes the claim of ownership to the land in which he and the Urhobos stay in Warri. He will be slammed with an eviction notice, ineffective immediately, which of course will be challenged in court, and we will go to court, where he will be told to either vacate the property of the Itsekiri people or be forced to make a public apology. I think the lawyers here on X can understand the court judgments above and below. The Itsekiri people remain the rightful owners of the land, and any claims to the contrary are null and void.
