From what I've heard, Sega does not own the rights to the specific song. Contracts are incredibly specific with regards to details. When a musician's song is used for a game (or other media) the musician would typically have sold either the ownership/distribution rights of the songs, or sell a license granting permission for a specific and limited use. "Live and Learn" would fall into the licensed category, with Sega having to negotiate a new license for every time they want to use the song. The suit is alleging they didn't have permission to use the song for many of the games that they did put it in. The reason this is coming up now is because Paramount did the correct thing and made a deal with the proper owner of the song to use it, which alerted him (who didn't really pay attention to video games) that his song was included in things he (allegedly) didn't sign off on. (I'm using "allegedly" because I wish to be cautious about putting possible misinformation out there. I personally believe Johnny is in the right)
