to all the people crying about misuse of law pls check this message , its a refutal of your claims 1.in foreign countries power dynamics is different , here power dynamics are highly towards men , laws are made as per condition of society because gender neutral mean not just on paper but to be gender neutral in effect , as per the condition since men have more power in indian society in every aspect therefore if we make it gender neutral on paper men will exploit it even more , the best way to show this is how rapes , sexual assault are highly unreported in India ( since 99% rape cases go unreported) 2. point about false rape cases is completely wrong , since as per NCRB 2020 data even if add false cases + non cognizable cases+ cases ended as mistake of law or fact then also the maximum false cases go up to 8% 3.syndicates are more of boys than girls ,more men have power to suppress cases against them, that is why sexual offences are not reported because the patriarchal notion in the society which is highly regulated by men always pushes women to not report the case. 4.make the laws gender neutral , yes but first make the society and power dynamics more neutral 5. marital rape is processed differently than any other rape cases , since in these cases the victim has to prove therefore the accused in innocent until proven guilty manu things such as past behavior , understanding of consent by partners and in laws and use of medical examination can be used 6. also not making the law is different from providing immunity to the rapist , the current system says that if a husband has non consensual sex with his wife it shall not be called rape therefore CRPC provides immunity to the rapist , the court can literally remove this and not make any special laws but check the rape case differently and arbitrarily in each case rather than making a uniform law 7. also by not making the law men are already misusing the immunity to rape their wives , any law shall be tested about how much gender neutral it is in effect not just on paper therefore even if we make the law the chances of women misusing it are still less than the chances of men misusing if the law is not made , therefore the law would be more gender neutral if it is made by default 8.literally marital rape is not solely proven on testimony itself but on medical examination , abuse , past behavior , understanding of consent by partner and sometimes even character examination of each partner by strict authorities also only 36 countries in the world don't have a law for marital rape so all the people crying about misuse see the above remarks
