I went through TN and got my green card a few months ago. You need to time everything and not travel for some period of time, so there is some risk specially with a layoff. Also you won't be able to extend your TN so ideally start the PERM process early but also not too early 😄

Im currently without legal status, My husband is filling out my i-130 and i-485, my travel history (B2 category) does show all of my arrivals and departures, but my i-94 just show my first entree, should i fill out my forms with my last arrival (stamped) and explain the issue?

A Mandamus is where you complain to the Courts that a government official is not carrying out his official duty, whatever that duty is. In this case USCIS officials are not processing your application fast enough. So you are asking the judge to command USCIS to do their job or face punishment, like a fine or a finding of contempt. Typically USCIS, if in fact they have taken too long for no real reason will actually speed up the process on that one application (but it depends on the individual circumstances -)

Thank you for this very helpful video for me. I am on a TN visa for the last 3 years and 12 months for my current employer. My employer offers to sponsor for a GC and since the H1B is already passed for this year, if we decide to go for directly sponsoring, do they need to justify to department of label why me and not a US citizen or I-140 would be the first step to the process? And how long is typically the process? Can I still be travelling internationally by the time the whole process ends?

I have national and state licenses to practice respiratory therapy. I am applying for TN under Scientific technologist (ST). Criteria for ST includes: 1. Proof of Canadian Citizenship) 2. Two year associate degree in Applied Science in Respiratory Therapy 3. Work under direct supervision of medical director 4. Theoretical knowledge in biology, chemistry and physics as they apply to respiratory therapy. 5. Not a construction type of employment. 6. Job offer from US employer. How difficult is it to obtain a TN Visa in this category? It does not seem as straightforward as other TN Visas.
