I'm currently going through this now in my state ( Pa.). My father passed last year (No will), and I (the son) currently live in the house, and have been paying the Home equity loan my father had on the house. We are at the very end here with the probate, documents are ready to be signed by me, my sister, and step mother, where I'll be taking over the house, all other parties satisfied...and the bank that holds the loan is pushing back on me assuming this loan without refinancing. The lady I spoke with at the bank, was on the phone with their mortgage rep, and she stated I "could" assume the loan, but had to refinance, and I believe she is wrong, with everything I've seen and read online, from other lawyers and mortgage reports. They are escalating this up the chain at the bank, and I told them I'm waiting on their response before I hire a lawyer for this.
