This looks like another lawsuit for the National Association of Realtors. This time it's coming from within and it will result in the dismantling of the NAR or at least make it almost irrelevant. There will be just State Association of Realtors (and no NAR) with opt-in, opt-out benefits or take aways. Why aren't the NAR tired of getting sued?

They have definitely monopolized the real estate agency trade. Another way to think about it is what is the alternative to NAR? There is no XYZ Association...just NAR.

As an owner of a non realtor brokerage, any agent that wants to join my company must leave all realtor boards, due to the tie in agreements. Recruiting is almost impossible.

Yeah, the AOR acts as a gatekeeper to many professional tools, so when you ask an agent to sever ties you are asking them to forgo their tools which makes it hard for your and captive for the AOR.

Sorry - I disagree with most of your video. I've been in the business 38 years. I just did a quick public records search of Orange County California for NOD's, Foreclosures, and REO and I found 932. I didn't check commercial ... I'm positive there are some office buildings. I realize your video is 2 years old but I'm sure you talked someone out of a very lucrative career as a REO Agent/Broker, as there is a wave coming, especially commercial. There are many buildings where the original data shows loan amounts over 100 million and now the property has a current appraisal in the $35 million range. My commercial data comes from a nationwide title company from Newport Beach. There are over 10,000 banks and credit unions not to mention hundreds of servicers and sub servicers. I'm not trying to cause trouble - just issuing another point of view.

Your point of view is very welcome. I have a limited knowledge base of distressed commercial. While I'm familiar with decreased demand for commercial, I'm still apprehensive about opportunity for anyone but buyers. As far as residential my position still stands. There are a series of layers that distressed real estate goes through before it opens to the public and all those layers scalp opportunity. I have been privy to every part of the process and I know the details intimately. Even when a bank takes back title they are too greedy to simply assign listings to agents. They make you use their platform and ask for a referral fee on your commission paid by note holder. They make you jump through hoops to a point of near emotional breakdown. The game is rigged my friend. Not just a little, but every step of the way, from start to end. I can assure you I didn't talk anyone out of a lucrative career, no sir, quite the opposite.

That was good, even though the current BBRC agreement was updated to include the Seller Payment To Buyer Broker and therefore, that isn't needed any longer.

Would be nice if you addressed Mutual Cancellation. Also, in a Mutual Cancellation when there is no EMD in place, I think it important to note that Termination of Escrow also release liability on both sides.....

A landlord can't raise the rental list price more than 10% in an affected area. It's simple, follow the law and move on.

What would be your answer to the question, “what benefit does NAR provide a Realtor?” I’m a new (sub 3 year) agent and am contemplating a new brokerage that uses StateMLS only.

Agents join NAR and the state local board for Forms, MLS access, and the legal hotline. These associations also have training and member discounts on other services. But, it's mostly because everyone wants access to standardized forms and the realtor-affiliated MLS. I run a realtor brokerage but I see that the time has come when a non-realtor brokerage can conduct business just the same. So, I'm helping launch CavourRealty.com, an independent brokerage.

That's not up to NAR, all they can due is state that a buyer' rep agreement with the terms of the settlement is used. Whether agents use addendums, compensation schedules, or even their own version of a buyer rep. agreement is none of NAR's business so long as it doesn't violate the settlement agreement. It's really managed on a broker by broker basis.

if the seller is in a trust do I put the "seller" as the name of a trust and then do a rcsd-s so that person can sign on behalf of the trust? Do the other people in the trust have to sign the rcsd-s?

Yes, trust name = seller name. Just the trustee(s) signs.

Hi there, I’m trying to wrap my head around my renovation credit on my home, and it was done as a seller credit but I didn’t receive a cheque…any chance you can walk me through it?

Did the seller credit you through escrow? If so, it would have reduced the cash that you need to bring to closing. So you would be in possession of more cash, that's where the credit would be.
