Justice O'Connor was awful when she first joined the bench. Her two early property rights opinions - Hawaii v. Midkiff and Yee v. City of Escondido - trampled on the rights of landlords and homeowners by approving the worst forms of state coercion. She somewhat redeemed herself before retirement with her dissent in Kelo.

I think Stevens will be remembered mostly for Administrative Law decisions, though Chevron was overruled this past term in Loper Bright, and the Massachusetts v. EPA case. Stevens also wrote the majority in the infamous Kelo case. Ginsburg will be remembered for the VMI gender discrimination case and maybe the case (wrongly decided) on requiring a Christian student club to take all comers, for any position, in violation of their club's religious policy.

Dear Josh, I am 25 year practicing attorney and started listening to these lectures a couple weeks ago to brush up on Con Law. Your teaching is excellent. So many things I didn't learn the first time, and didn't realize how far the Necessary and Proper Clause reached. Thank you for recording and posting your lectures! One counter-example to your pop question on who the federal government can require to take action. The Motor Voter Act. Federal law requires a state to provide driver's license and other applicants the opportunity to register to vote. The Act goes beyond a state's DMV, deeper into state operations, including registering disabled people and welfare recipients, and requiring states to designate agencies to carry out the law. (Edited portion two: one of your students raised the Motor Voter Act in the next episode and you're right, it was upheld under Article 1, section 4 and the Necessary and Proper clause of Article 1, section 8.) If I recall, federal age discrimination laws do not apply to state judges under principles of state sovereignty, and the Supreme Court held briefly - later overruled - that the commerce clause did not empower Congress to apply the overtime and minimum wage provisions of the FLSA against the states. (Edited portion: you discussed this case a few seconds after I paused to write my comment!!:)) Finally, on the federal government's power over individuals, you're absolutely right. There is even a federal obligation on any individual convicted of certain sex crimes to update their sex offender registrations when traveling in interstate commerce.

I disagree with the idea that the constitution doesn't give powers. Art 1 Sec 1's first line is clearly contrary to that idea. In a state of nature the government doesn't exist. All it's abilities are those granted to it by those who made it. We the people.
