I saw some comments online that said that the scooter did not meet the criteria of a 'vehicle' status - does anyone know if this is true? If that is the case, then doesn't it mean it's not a DUI? And why are they not telling us the BAL, especially after the wrong information of 0.227 was thrown all over the place? He looks so steady while driving and just lost his balance at the end when turning, so I find it hard to believe that his BAL level was that high?
