Hey Ms. Baler, regarding a trust.. (can one just add the would be beneficiary as a joint account holder to say ones own savings /checking account.. to avoid being taxed as well and have immediate access to those monies, if one passed away.)....???? I do understand now.. The trust allows one to get public benefits.. if needed. Thanks for explaining that.

Good video. If a spouse owns the home all by themselves (including on deed) and then does a Will giving it to a cousin or friend, does anything in the Homestead Law say the surviving spouse or children to 21 get it. I know they are protected against creditors, but do they get to own or use the house if the owner didn't Will it to them? I am excluding whether the Elective Share law may let spouse use the real estate. So, does spouse or children ALWAYS get to use the Homestead????? In Mass. Mass law is confusing .

Ask a professional about making your heirs the trustees. This might not let him live in the house until he dies, but you may well have to decide between leaving the house to him, or to your heirs. Another option might be to pay a fiduciary professional to be a trustee, leaving disposition of the house to a (hopefully) completely disinterested person.

Medicaid and Nursing Homes have a 5 year look back policy for what they call asset recovery. They can put a lean on your home for reimbursement of payments for your long term care and health expenses even if you transfer the title to someone else, (like a family member), or put your home in a revocable trust. Placing your home in a trust at least 6 years Before the need for Nursing Home placement can help to prevent such leans. Setting up an Irrevocable Trust Fund for nursing home and long term care can also help prevent having a Government or nursing home lean on your house.

Many, many years ago, before I was born, my aunt and uncle were killed in an accident. My uncle either died at the scene or shortly after he arrived at the hospital. He had a will that left everything to my aunt but made no provisions for his underaged children. She died 3 days later without a will and with 5 minor children, the youngest of whom was only 2 or 3. That meant that estate couldn't be settled until he turned 21. Basically they couldn't use any of ny aunt and uncle's money and had to go on welfare plus contributions from the extended family. My parents' wills always included the requirement that the beneficiary must survive them by 30 days, else there was another beneficiary, plus providing a guardian for me. Other people's parents threw big parties or bought them a new car when they turned 21. My parents took me to the lawyer to write my will. They also had to redo theirs to reflect that I was of age and didn't need a guardian. And please go to a lawyer to draw up your will. Don't do it yourself or use one of those will kits you see online. You have no idea how much money lawyers make fighting those wills in court. Many of them don't even meet the most minimal legal standards for a valid will.

Honestly, creating a trust is not that bad or hard. The lawyers do everything. The initial cost will sting. It could cost between $5000 to 10,000. Depending on the complexity. The cost definitely outweighs needing to go to probate. Because that could be a very lengthy process. Even if there’s no family turmoil and maybe you’re single or maybe have a couple siblings. Having everything in the trust is so much easier to liquidate then going to court and proving everything is passed down to you. The trust and a death certificate that’s literally all you need when needing to work with the bank, the town, realtor, etc. We kind of dealt with this when my wife’s brother passed away. He died intestate which means no will or trust, but his assets were below $186,000 (which is the limit in our state before you have to go to probate). It was so much easier closing his bank accounts re-registering his car. No court involved at all

And the Estate Planner who promised peace of mind refused to help because he spent the 10 grand to keep the lights on. A complete Forgery Proof administration with about a hundred steps behind closed doors cost 5 to 10 percent of our gross estate value. For a NICER approved Legalese Administration Lawyer and their team of allied legal professionals protecting us when we're vulnerable and our loved ones when we're not around.

Any "Trust formed under or within the jurisdiction of the statutory policies of the [District of Columbia] is still subject to legislative enactments. See Blacks Law Dictionary 4th edition.

Be very careful about refinancing. Apparently my mother-in-law did that. The house was pulled out of the trust but never put back in. We didn't find out till about 10 years later. She was still alive but we had to pay the attorney to update the trust and pull the house back in. So just double/triple check. 🙂

@@TrustVictims And it's not so much fraud or a scam. It's just that when you refinance, for whatever reason the house gets pulled out of the trust. I am sure it was on the up and up however with a 70yo mother in law, I am not sure she fully understood the ramifications. Or if there is even a choice to opt out to pull the house out. Anyways, just FYI if you refinance with a house in a trust 🙂

Regarding what you found about Lincoln declaring Thanksgiving a national holiday: This was, as I understand it, an action full of significance. 1863 was in the midst of the Civil War. Thanksgiving was celebrated in many localities at that time, but there was no sense of it being a a national ritual. Lincoln hoped that by declaring it a national holiday, it would provide a little bit of a sense that "we all do this together, North and South," a glue that might do its small part in binding the nation together.

It sounds like Massachusetts has it right. It would de-incentivize people to murder their families and friends. Besides first-degree murder is the most serious crime one can commit and usually is punishable by life in prison or execution which would render they're goods useless because if you're in prison you cannot go to the bank and more than likely they will not come to you.
