Do you know the law on mineral rights in Georgia? We are trying to sell property that we inherited and during title search it seems that a man inherited and owns mineral rights and is basically extorting us. He gave us a 10% of sale number only if a different law firm changes something on a unassociated deal in the past that they closed. If this 3rd party doesn't agree to do his will, he wants almost 50% of our sale price.

Unfortunately, I'm not an attorney. It's extremely common for the surface owner and the mineral owner to be two separate parties (in fact, hundreds of people could own a fractional interest in the mineral rights). Georgia is not on the list of the top 25 oil and gas-producing states, and my knowledge of mineral rights is limited to oil and gas (and other minerals produced with oil and gas). If I were you, I would consult with an attorney in Georgia. Perhaps a different buyer wouldn't care if the land didn't come with mineral rights?

If you are getting multiple offers, a broker may be interested (after all, they are going to collect a fee for connecting the seller to buyers). It doesn't hurt to reach out to a couple of brokers and gauge their interest.

Do a title search (abstract) go back as far as you can, it is time consuming. If you have any questions always talk to an attorney. And also look at the tax books in your county at the courthouse. That is how I learned.

Unfortunately I don't own the minerals under my land here in West Virginia but I did declare by affidavit I own the Renewable Energy Rights and Air Rights on my surface land. I hope someday oil and gas and Renewable Energy both find a happy common place.

Many states are not allowing the wind estate to be severed from the surface, so as long as you own the surface, you probably own the wind and solar rights. It'll be interesting to see how the caselaw evolves.

Under West Virginia SB 5 the state has commented that in the event that they own or purchase the airspace above the road interest they already have they have the right to sell or lease that airspace for drone commerce, that is my understanding but for personal land I think things may change in the next few years. What would happen if your parents transferred the ownership of a producing well mineral rights and recorded the deed to you before there death? But you allowed them to collect the checks from the operator and they claimed it on their w-9? Would you have any problems getting the operator to change the check to your name after their death and would there be any other problems?

@@fredstevens4148 From what I understand, most operators do not know that a deed has been filed unless you notify them. That's why notifying the operator is a part of the ownership transfer process. I don't know the legal ramifications of your proposal, though. You may want to consult an attorney.

Question: Have you ever heard of Golf Atlantic Researches? I looked it up, and it barely registers on google. The few links on the web that I have found says that it is no longer in operation. Also, how would someone know if anyone's land has any minerals in the first place? Would he have used your technique?

There are tens of thousands of companies in this space. I have not heard of this one, but even if I had, I probably would not publicly comment about another company. Your other question was about knowing if the land has any minerals. This is a complicated question. It depends on where the land is located and what type of minerals you are looking for. Some areas are known to have oil and gas, while others are known to be devoid of economically recoverable oil and gas. Still others have been depleted of their oil and gas. A petroleum engineer could do studies to determine the likelihood of recoverable hydrocarbons, but that could be overkill if the land is in certain areas where the geology and economics are well studied.

This family has owned this property forever and never explored or should I say, never contacted by an oil company. My neighbor has an active oil pump about a 100 yards from our north property line. Is there something on the pump indicating the oil company associated with the lease?

If you own 100% of the mineral rights and have very deep pockets, then sure! This almost never the case, though. Some mineral rights are taxed regardless of production status while others are only taxed based on production - it depends on where the mineral rights are located.

When I decide to do business with an oil company do I have to engage with the other 7 members of my family to use my mineral interests? Likewise with them?

If your portion of the mineral rights are in your name, you should not have to engage with other family members to lease your portion. If, however, the mineral rights are in the name of another family member (such as a parent or grandparent) and the minerals have not officially been divided among the heirs, then you might need to coordinate probate or whatever is needed to transfer the mineral rights. This is a simplistic answer. In reality, there can be other situations, such as owning an NPRI or having the minerals owned in a trust, that would impact the answer to your question.

What do you find to be untrue? The process of transferring mineral rights is relatively the same across the 12 states I work in, but Louisiana operates under a different body of law, so the process might be different there. I'd love to know what you find to be untrue and which state you are referring to. I don't know everything and certainly welcome the opportunity to expand my knowledge base.

The deed records will be kept with the County Clerk or Recorder of Deeds (they have different names in various states). It sounds like you need to hire an oil and gas attorney to help in this situation.
