Do you think it's possible to start your own real estate lawyer firm right out of school, with no experience?

I think anything is possible (within reason)! You will need to be diligent about researching the real estate market and how to run a law firm. It will really help if you find a mentor. This can be another attorney who has done this, a consultant you pay, or find a class or mentorship group. Do you have previous experience with real estate? That would be beneficial for that niche also. An alternative that some people would prefer is working for a real estate firm for a few years, then venturing out on your own.

This is almost identical to mine, at least for what little litigation I do. I would add though a folder for "Engagement-Billing-Expenses". Probably the most important folder I have is called "To Review". The To Review file is a catch-all for all the documents and communications that come in for that matter. The person receiving the mail scans it and puts it in the "To Review" folder and puts a task on the attorney's task view saying to review that case. I call my drafts folder "Working Docs" and it contains anything from sample language, forms and drafts, plus I have a subfolder E-file notices. I do a lot of business startups where I have "Corp Book Docs" for everything that should be kept in client's corporate book. I also have "Recorded Docs" for real estate. Or "Executed Docs" for a contract case. Basically, you want a folder with PDF's of all the final executed documents for whatever kind of matter you are doing.

This video is awesome! I find it extremely informative! Can you discuss fee structure more indepth? Such as when to use hourly vs flat fee vs retainer vs multiple simultaneously?

Thank you for your feedback! I strive to use flat fee as much as possible, but sometimes find that in litigation cases it still makes sense to use and hourly fee structure. Personally, I do not do a mix of hourly/flat fee billing on a single matter for a single client, but I do have several hourly-billed clients in addition to my predominately flat fee cases. Whether it is hourly or flat fee, the first thing to consider is whether you (as the business owner/lawyer) can afford to do the work at a particular price point. The second is whether it makes sense to the client and to make sure they see the value they are getting for that particular cost. You can break flat fee cases into “stages” such as negotiation, discovery, pre-litigation, litigation, etc., and have certain prices for each stage rather than demanding an entire case fee up front. This often works for both the client and the lawyer.

If you want more direction, consider breaking your review down as follows: What type of issue were you having that let you to hire your attorney? What did the attorney do for you, or what was unique about how they solved your issue? How did the results of the case impact your life?

I’m trying to use the MailDrop. I’d rather use it as a CC, than a BCC, so the responses also go in the file automatically. The mail drop address is ugly, is there any way to fix that?

I frequently use it in the CC as well, although I have not found a way to make the link any less ugly. And to encourage responders to “reply all” so that all the responses automatically go into the Clio matter, I incorporate a message like this into my Email signature: ** Please do “reply all” to this email so that our organizational system maintains the entirety of the communication chain. **

Organizing files in Clio is great, especially for sharing files amongst team members, or co-counsel with other firms. One downside is that the visual user interface or file structure looks a bit different than what Microsoft users are used to. So it can take some familiarizing.
