It is called Scots law but on the bottom of the tin it says ‘Made in Italy assembled in England’. An imported and copied legal tradition that is reflective of Scotland inability to develop its own laws. Compare this to England who for 1000 years developed its own equitable and common law principles!

O.K., prejudices are bad. This is not new, but it is important to be aware of it again and again and to critically question oneself. Here comes the problem: Do I have to take all views seriously just because someone says so? There are crackpots (UFO believers) and sometimes people lie. Some refugees are wronged because they don't understand the national language. Others throw away their passports and tell a story at the border. The problem with these postmodern approaches is that they think in categories of discourse and "oppression" and ignore the question of truth.

A few points: 1) The imperialism that led to these institutions really shouldn’t be celebrated. I think quoting David Cameron highlighting this structural exploitation is slightly perverse. 2) The written constitutions these nations have are a rejection of colonialism and these countries regaining their freedom. 3) The lack of a coherent constitution in the UK has increased the dissymmetry of power between the political elites and the electorate. This has practically removed political agency from an entire nation - highlighted by Brexit. 4) Without a written constitution, we have no leviathan to protect the people from the increasingly extreme laws being introduced by the Government. The rights of workers to withdraw their labour is being compromised to the point of tyranny. Furthermore, the very existence of democracy is in the balance after the UK Government blocking the royal assent of a bill passed by a devolved administration. James Otis said taxation without representation is tyranny. We are beyond that now. We have tyranny overruling our representation. 5) This erosion of civil liberties is being accelerated by the campaign to exit the ECHR. This is despite it being woven into the fabric of the Belfast Good Friday Agreement. 6) Judges cannot be trusted to interpret with such a fragmentation of the laws. The Supreme Court decision against allowing the Scottish Government to hold a referendum in its own country, despite it having a mandate from the people, illustrates that the judiciary needs guidance from law. The rule of law itself is being eroded. 7) Just a side note, the issues faced by the US from it’s constitutional interpretation is the ambiguity caused by antiquated language. The second amendment’s “The right to have a well regulated militia” should really be taken in the context of being written by Hobsians following a revolution. However, it’s twisted to mean one has the right [some argue civic duty] to keep weapons of war in your suburban bungalow. We would need to ensure the spirit of the document is not forgotten.

El problema no es la tarifa ni bajo ni alto. El mayor problema es la corrupción es la falta de patriotismo por parte de nuestro funcionarios de alto de cargos solo piensan en sus beneficios propios o de algunos grupos pequeños eso es la realidad

I just need to be sure. So a qualifying law degree in the university of Edinburgh doesn’t qualify you in England and Wales at all??? Do you really need to do the GDL ?

I know this is late but you are correct,it’s only a Scottish Law course.There are only two places in Scotland(I’m pretty sure anyways) which offer law courses which apply to England and Wales and that would be the University of Glasgow with Common Law and University of Aberdeen which is Law with English Law.

I feel as a white man I experience epistemic injustice because we are continuously perceived as the bad guys and apparently need to own up to our “white privilege” and the previous actions of our forebears. ...oh wait sorry it doesn’t go both ways..

You sound a little bitter, friend -- If I can be frank though, I think that's misplaced. From my perspective you are not engaging strenuously enough with the ideas you're talking about. I think if you took some time with the concepts of whiteness and privilege, looked at the history and also how those elements can play out almost anywhere, if you were able to discuss and ask questions of somebody in a setting you didn't find threatening, you might feel more part of the conversation. I think people are blowing you off because you haven't done the investigative work to look at the ideas and claims of people affected by privilege and whiteness. There are places where you can find more to read online, but I agree with you that it's hard on a new learner when you can't ask "hey, I'm new to this" questions in a judgement-free zone. I had people I could talk to about these ideas, which frankly were mystifying at first, and that made it much easier overall to understand and integrate. (They are putting names to phenomena so ubiquitous that they are invisible until you name them and start to recognize them, so it's not unreasonable to be confused and even angry about a thing you've not noticed before.) I think if you came to it committed and curious, and you asked questions about others' experiences or what you're missing, people would respond in good faith. Good luck, I'm sorry you're feeling isolated with these concepts.

@@kyeflans still.. he has a point, albeit a somewhat crude one.. there's no doubt that white people have a certain level of privilege but that doesn't mean that all POC don't have privilege. in the same respect, just because racism against whites is less common, that doesn't mean it's not possible in certain smaller contexts, and it certainly doesn't mean that white people dont experience hate or prejudice. privilege and racism don't mean "the only privilege and racism that matters to certain people".. that would be epistemic injustice because racism and bigotry don't really qualify as epistemic injustice, at least not in my understanding of epistemology, until there is a barrier which deliberately prevents a discursive change to occur. beyond all that i don't really see the utility of the phrase anyway.
