I was disqualified from running for the board due to outstanding account balance. I accepted the IDR offer and requested records that will help my case. The property manager refused to provide the requested records and gave me two days' notice per email to meet. She stated that if I couldn't attend the meeting, I refused the offer. I immediately informed the property manager and board president I cannot attend due to the short notice and our governing documents state we must agree on a mutual time and place. I requested ADR after sensing the board was acting in bad faith. The HOA'S attorney said I was offered IDR and I couldn't be on the board because of my outstanding account balance. I replied with a request for ADR again and the contact information for the inspector of the election. Afterward, the election disappeared, and no ballots were mailed or update dates provided. Did the board follow the law regarding the IDR law?

Our new HOA attorney is the attorney for our new property company. Our property manager and attorney came up with our prior property management company had poor bookkeeping and provided the board with not accurate financials during the annual budget preparation for a few years. That resulted in a emergency special assessment. The meeting minutes did not reflect the allegations, only the board directing the property manager to consult with a attorney concerning a special assessment. After homeowners pushed back and filed a complaint with the Attorney General. Our attorney admitted there was no audit conducted and no evidence exists. In the resolution letter mailed to the homeowners it stated the new property manager discovered the accounting problem, the new property manager accounting department said they have no idea what the property manager and attorney is alleging. The HOA's attorney still insist there is evidence but failed to provide any. The board still insist on demanding the emergency special assessment monies from the homeowners.

I live at HOA that is ran by a religous cult, they hate me because I don't believe in thier indoctrinated, programmed deception. They constantly descriminate, harass, threaten & target me because I will not agree to join thier cult. They have even blocked me from getting mail, how can they control USPS? I am elderly & disabled, where can I find protection from this evil HOA?

Should the election ballot be categorized with the board positions and who is running for each board position or should the ballot just be an alphabetical list of candidates? If it is just a candidate list then does the new board vote on how to assign board positions. Maybe it’s just me, but the civil code isn’t clear enough on this. Thank you!

I’m on the the board. What does board do if our attorney keeps reaching for different ways to defend the issue when the issue is written on the plat? “HOA maintains perimeter walls”. He pressures us to fight everything so we don’t have to pay. I’m sure he is just wanting to make money, which should be illegal. He stated it doesn’t matter what was written on the plat 20 years ago. I am referring to the side of the perimeter walls that abuts common areas. CC&R’s are vague and doesn’t mention perimeter walls only maintenance of common areas. He also stated party/shared walls doesn’t apply. We have already spent $11,000. Suggestions please .

I can tell you that the case of the landscaper and the homeowner DID NOT end well. The 2 Board Members refused to follow any of the DEFH requirements. The Board members REFUSE to follow the law. The 2 Board Members FAILED the following elections in order to stay in power. The 2 Board Members are father and son The 2 Board members are beyond rogue. There is sooooo much more to this.

Yet another in a continuous string of excellent ECHO presentations. This one, "2021 HOA Landscape Lessons" was particularly pertinent, given the subject matter, time of year, and qualifications/expertise of the presenter. If Mr. Justin White was a "stand-in speaker", then the talent certainly runs DEEP at K&D. The presentation was information rich, the answers to the questions were thorough and to the point. Thanks to everyone involved. I came away with a wealth of new information. And it was FANTASTIC to see so many people in attendance, paying close attention, asking great questions, and staying to the very end. David Z and Hannah deserve strong praise for putting this together so well. And ECHO should be proud of its ability to truly live up to its name. I look forward to the next seminar, as always.
