Scenario 1 Buyers agent fee is negotiated with offer. Scenario 2 Buyers agent fee is Spelled out and offered prior to an offer. Which scenario is preferable? Commissions are negotiable when we enter into a buyer rep agreement or a listing agreement. I would rather not negotiate them later.

But it's one term in a series of terms. You're missing the entire point of the NAR settlement. Also, it works both ways. If a seller is offering less than what a buyer's agent has it under contract for, that can be a negotiated term.

Well, everything is negotiable all the time, in theory. When we get hired, the consumer should know what they are going to have to pay. But certainly they are negotiable when we make an offer.

Hey Steve! The difference now, as I understand it, is that it's legal and you don't have to have separate E and O insurance. I think many people were doing this without getting insurance and registering with TREC and TREC was looking the other way.

Fellas what a great presentation. I haven’t been to any of the meetings - So Austin and Chris if y’all attend these are Some developer issues we need to address - these are just things that popped up while listening Fire separation - now if we build closer than 10 feet we need a more costly fire rated assembly which will drive up cost to build. What will AFD require - we need that answer to properly design and permit Utilities - on a large lot - if you have to “subdivide” and go thru that lengthy and costly exercise that’ll slow us down and cost a lot more - then to just have 3 units with little outdoor space and will affect overall form and architecture of units. To get a tap plan and 3 separated water/sewers in will cost a lot and if it’s cut up into lots to can run them thru the other newly created lots without an easement - but these will have to on an interior lot - a corner will set up where they all 3 get off the lot but still an expensive addition. We need someone to provide thought leadership on these topics from COA THANKS and much respect for all 3 of you.

Zillow buying FUB might be more about looking at best practices used by Agents than the actual customer data. There is a lot of data there about how agents interact with clients and what works best.

I agree, Amanda. This is insane and will certainly make major impacts on home values overall because historically it’s been figured into the sales price so sellers aren’t upside down. The reality is, if the buyer isn’t willing to pay, then they won’t be represented - no one works for free. That’s just silly. If the buyers go unrepresented then there’s going to a flood of lawsuits between buyers and sellers down the line. Well said guys!! Thanks for sharing!

Maybe. Or maybe they knew that many in the industry doesn’t trust Zillow and they want to ensure their clients (agents) that the data is collected. I think its in the best interest of FUB and Zillow to install confidence

This is just me thinking through my fingertips! I have no doubt that some of us will flourish and it will weed out a lot of agents that got in because they thought it was easy. I agree that how commissions are paid have been miscommunicated by many agents or not communicated well at all. At the same time, I have always been told that commission was built into the price of a home (so essentially the buyer is paying the commission even though it's coming off of the sellers "proceeds"). If sellers are not willing to pay a buyers agent commission, should the price of the home decrease by 3%? If in MLS, a sellers agent is only offering $1, a buyers agent who has explained the buyer rep agreement to their buyer correctly can still put 3% in the offer and maybe that consists of upping the sales price (okay'd by the buyer of course). I just feel like so many things can get willy nilly through the transition of this, but I'm here for the ride!
