@@colonel-h2b the officer was not in the right. Here's why: 1. In the US where this situation happened, under the constitution, we have protected freedom of the press which gives every citizen the right to record public events (meaning if it is out in public it's legal to record). 2. The police were conducting an investigation and the couple of people in the car were recording the investigation. Under the first ammendment under freedom of the press it is completely well with in their right to do so. 3. The only way the people would have done anything wrong is if they impeded in the investigation which they did not. They were following and recording which falls under the first two prior statements I made. 4. The officer escalated a situation that should have never happened. He got fired for this and violating those peoples first amendment right. Officers should know the law and the constitution and it was clear that this officer should have never been given a badge.

You're being recorded at the restaurant, post office, hospitals, malls everywhere you go, every police officer has a camera and they're recording you and everyone how come no one complains about that?
@ViyellaSun6 күн бұрын
@@NOTTHEENDOFFREEDOM because body cams are used for a variety of things and can also defend or also even catch a corrupted police officer and or a cop abusing power. Because bodycams were invented to get the full story on how a situation occurred. Also recording in public is completely fine and is not illegal unless the person feels unsafe or endangered. Lastly if im in the force and im driving down the street and for instace i randomly get shot at (because this has happened before) im not gonna go "oh hey now let me get this thing on real quick"
@wickedbasket88585 күн бұрын
@@ViyellaSun this video was recorded before body cams. Also "recording in public is completely fine and not illegal until someone feels unsafe or **in danger**" (I fixed your statement. In danger and endager is two different things) is a false statement. The law states that anyone can record anywhere public no matter the circumstances. It becomes harassment and stalking the moment someone asks the person to stop recording them and starts to walk away and the person recording starts following them but this only applies to citizens. Officers in uniform both on and off duty can not ask you to stop recording them as they are public servants and so long as you are not imeding in an investigation (such as standing physically in the way putting yourself inbetween them and the place they are trying to investigate or talking to the person they are trying to talk to for the investigation) it is well with in your first ammendment right to record them. Your right ends when they are heading home and/or out of uniform. Then they become a citizen and the law about following and harassing citizens then start to apply in which the officer off duty out of uniform can request that you stop recording them. Another thing to keep in mind is that body cams can be turned off on site. So just because they have bodycams doesn't mean we have to stop recording their behaviors.

@@stephenmadl5609 1. Following police in uniform around recording them does not fall under harassment and stalking as they are public servants and it falls under freedom of the press so long as the officers are on duty in uniform. It is also protected under freedom of the press to follow an off duty officer in uniform around and record them. That right ends when the person recording follows them home and/or when not in uniform off duty. Then and only then does that become harassment and stalking. 2. These officers were performing an investigation and these people were following them to record the investigation which is well with in their legal rights so long as it doesn't impede the investigation which it did not. 3. It was a couple of people in the car and this was 10 years ago that already resolved legally. 4. The officer escalated a situation that should have never occured. His job is to enforce the law not violate or make laws. So...he is in the wrong. This is why the other officer pulled him away.
@ViyellaSun5 күн бұрын
@@wickedbasket8858 no this is not true. Freedom of press is to record a police officer in live action or at a crime scene. Following someone is considered harassment because it can lead to a feeling of unease or risk of saftey. does not matter if they are public servent or not. If they did follow them just to follow that is harrassment
@wickedbasket88585 күн бұрын
@ViyellaSun they were in live action. And yes it does matter if they are a public servant or not. They are servants of the public it is legal to follow them around while they are out and about recording them doing work. It becomes harassment the moment they are done with their jobs and are going home. You can not follow them around when they're doing traffic work as it could cause problems with traffic and imeding traffic is violation of the law. But you can certainly follow officers around and record them if they are on duty all you want so long as you are not getting physical with them. If they are walking down the side walk in uniform on duty it is legal and protected by freedom of the press and they can not by law tell you to stop recording them. This doesn't just apply to "being in action" or at a crime scene. Federal courts decided this because of this video and many others like it.
@ViyellaSun5 күн бұрын
@wickedbasket8858 took me 5 minutes to disprove your statement with one google search. Your relying heavily on if they are doing active duties but then what about when they are just driving around patrolling. You cant follow them and record them that is just an invasion of privacy. Simple as tbat.

This is an old video, the driver and his girlfriend were in the car and they drove past them a few times to film what was going on, so the cop decided to stop them and harass them and threaten their lives because they were filming. This video is about 10 years oldand it’s only helped to increase Cop watches and First Amendment auditors because of guys like him, like this cop are everywhere and they are the majority of police officers. Police officers act like they care about you but in reality they don't care and use every tool available to them to violate your rights, do you want to see them getting to you and start to violate your rights just pull out a phone and record them you'll see how they change from being a public servant to a complete tyrant.
