You can get banned for absolutely nothing. I had a 2 day account where I only played World of Tanks with no communication and First Descendant. Then a 12 hour account where I only watched KZbin to go to sleep to. Woke up and started First Descendant. Banned. For what?

You can set up the switch without being connected to the internet or WiFi. If you buy game carts, you can play 98% of the games in offline mode with full features. Plus on the back of the games, it will tell you if there's downloads required or not. So, if there isn't one required for that game, you can literally buy the physical copy and put it straight in and play. IF you do want to play online then obviously, you need an online account and all that jazz, etc.
