No, I do not agree with the charge of homicide against Bobby due to the presence of qualifying circumstance of treachery in killing the three victims. Under the law, the crime of murder is committed when the killing of person is with the present of qualifying circumtances of treachery. Further, the case law dictates that treachery is present when the attack is sudden and without warning against the victim. Here, the treachery clearly present when the crime of killing the victims committed by employing the sudden and without warning attacked by means of gun shots. Eventually, they died instantly from the gun shots inside the Karaoke bar while they are drinking and singing, and the victims donnot even an opputunity to defend themself if the said attack. Hence, Bobby is criminally liable of 3 count of the crime of murder.
