If anything people in these higher positions of government should be held more accountable simply because they have such a postion. Shameful that they are allowed to simply walk away...

I think most if not all Saudi diplomats claim to be royal family member and as such can not be touched even in UAE. They seriously BELIEVE the World exists for them and them alone. If the country wants to have their embassy as they have some business relations- they will get them and trouble which they might bring with them. While a country has a right to ´agree upon´ who is to be send, they will only get offered the royal family members, so there is not much to pick from.

Can you explain why diplomats need immunity from prosecution in order to do their jobs? I've heard the arguments and they're not persuasive.
@hooverkinz
@hooverkinz 5 жыл бұрын
I think the biggest argument would be that they’re pretty high up officials who are in another country permanently, so if the relationship between those two countries go sour, the diplomat could be arrested on false or trumped up charges and the diplomat in custody would be used as leverage to for that country to get their way. North Korea has done something similar by arresting tourists. I still don’t really agree with the immunity, I think if they were charged they should be deported to their home country, there should be an investigation and face charges in their native country if it seems like they’re guilty and be replaced by another diplomat immediately. The reality is though they probably won’t be in much trouble if the charges are true, but isn’t that unfortunately the case for most high up officials anyways?
@acetate909
@acetate909 5 жыл бұрын
@@hooverkinz Yes, like I said, I've heard the arguments and they're not compelling. It may have made more sense 70 years ago when information travelled slowly and diplomat's were isolated in foreign countries but the proliferating of high speed communication makes this these laws sound silly. Also, the scenario you're talking about doesn't make sense. If a foreign government wants to go rogue and punish someone these anachronistic laws aren't going to stop them. If relations between two countries go sour than the offending country doesn't have the need to treat foreign diplomats well and can easily find a way to side step immunity laws and retaliate against them. You mentioned North Korea which is a perfect example. They just say an "accident happened" and it's almost impossible to prove otherwise and even if we do prove they're lying how do we punish them? Sanctions have limits to their effectiveness.

@@hooverkinz My reply wasn't intended to be condescending. I appreciate your response and I believe you're correct in your line of thinking. What you've stated seems to be the impetus for diplomatic immunity. I'm simply saying that it's an outdated and ridiculous concept to hold anyone above the law.....(cough cough the POTUS.)
@hooverkinz
@hooverkinz 5 жыл бұрын
Evan Fields no I totally agree! I wouldn’t use what I said originally as an argument necessarily for diplomatic immunity but I think it’s the most reasonable argument. But you’re right it’s very dangerous for anyone to be above the law and what you said is right, they’ll do it anyways and we can’t prove anything. Very well said! Thanks for your reply as well, I haven’t thought a lot about that side of it.

You should have mentioned that the local governmant can declare a diplomat a persona non grata and even rovke the diplomatic accreditation. The diplomat will then have to leave the country. Regarding reckless driving by diplomats, there shold be a policy that such vehicles will be rammed and wrecked by "unknown" drivers...

The host country can't prosecute someone with diplomatic immunity but it CAN have the diplomat removed or even suspend diplomatic ties if the diplomat's home country doesn't co-operate. Perhaps should have mentioned that.
@shebbs1
@shebbs1 5 жыл бұрын
Many host countries don't want to go to the trouble of doing this, for many reasons. If the host country is the weaker one then it might not want to upset a more powerful country that may also be an ally. If it is the stronger country it might be pride. Note that countries that protest the actions of foreign diplomats often have ones who misbehave themselves. Removing diplomatic status and suspension of ties can be, and is done, but usually only for very serious issues, and diplomats so affected tend to be lower ranking scapegoats. The diplomatic community sees itselt as an exalted class, but they are well known for abusing their positions.

I grew up in Washington DC and am all-too-familiar with diplomatic immunity. I worked in a gas station next to the Watergate complex and had many experiences with diplomats and politicians. It was so common for embassy people to drive off w/o paying that we didn't bother reporting it. I strongly suspect many had no diplomatic immunity but just used embassy cars with DPL diplomat plates.

Let me tell you, dear comment reader, a story about this video. This morning before work, I opened YT and checked my subscriptions and I gave each video a half-second look to see if I was interested in the video. When I came home to watch "10 Strange Crimes Committed By Diplomats" I decided right then and there that each video would get at least 3/4 of a second from now on, because this morning I read "10 Strange Crimes Committed by Dolphins".

Hey there! Amazing video, thanks for the info, it is helping me with a College assingment. Although, I think you should double-check the info about not paying rent, because the Vienna Convention on Diplomatic Relations, which regulates the matter, specifically says that the immunity does not apply to a private property if it is not held "on behalf" of the sending State, as follows: Article 31 1.A diplomatic agent shall enjoy immunity from the criminal jurisdiction of the receiving State. He shall also enjoy immunity from its civil and administrative jurisdiction, EXCEPT IN THE CASE OF: (a) A real action relating to private immovable property situated in the territory of the receiving State, unless he holds it on behalf of the sending State for the purposes of the mission;

@tomwebb3081

It prevents less salubrious countries from applying "pressure" to diplomats/countries by bringing nonsense prosecutions and essentially holding a diplomat hostage within their jails etc. I can see that not every country is so inclined but if you treat one country differently to another with diplomats that could lead to a diplomatic incident and the expulsion of diplomats.
@rdbury507
@rdbury507 5 жыл бұрын
@@tomwebb3081 That's the theory, and it sounds reasonable given absence of evidence. But a lot of things which sound reasonable turn out to be completely wrong when you actually perform the experiment. As it stands diplomatic immunity is best known for letting criminals escape justice rather than protecting innocent diplomats. I realize it's a complex issue, and perhaps a more nuanced solution is called for. There has be some middle ground between "everyone gets off scot-free" and "anyone can be thrown in jail for no reason".

Diplomatic Immunity is a courtesy that is supposed to help avoid problems with ignorance of the law and cultural differences. For example: If an American in Dubai had an affair with their secretary, that is punishable by law; as it is illegal to have unmarried sex in the UAE. Immunity is supposed to protect against these types of problems.

time for the UN to revisit the rules regarding diplomatic status, if a person representing a country on foreign soil acts like a criminal they should at least be instantly removed from the country and banned from ever returning. How is such a simple solution not a thing already? Diplomatic status should only offer things like preferential treatment at entry points and special security measures for them and thier families. maybe also stuff like personal transport and accommodation paid for by the home nation. However, no pay = no place to live

Why is the cyclist one so high up on the list? First, it seems like he was getting out of the car and just didn't expect to have a guy flying past his car at high speeds. Also, he was going way too fast for cycling in the city if the collision killed him and it was due to his own stupidity. Finally, it was a cyclist. Isn't causing the death of a cyclist about the same level of criminality as causing the death of a sewer rat?

After that term they were meant to go back to the farm or they're fishing or whatever they did. Nearly everybody was supposed to get time serving the country and their state. It was never meant for people like Claude pepper who nearly died in his chair during the workday on the floor. 20 shorty 60 almost eighty years these people are in the house and Senate and have made it their career which is partly the fault of the American voter! It was never intended to be a career it was intended to serve and go back home to your work. These people who have been there decades including Maine's own Susan Collins nauseate me!

How'd you get that? There were 2 examples from the Middle East and 3 from the US, plus other nations. Other than having a problem with maths what's your problem with the continent you mention?

Why then was René Gallimard charged? Was it because the circumstances were more intrinsically related to his job than many of these other cases where diplomats were allowed immunity?

I really don't get why diplomatic immunity is even a thing. It's just a license to get away with crime #1 assuming the men where about to attack him it's not that bad How does a soldier get diplomatic immunity? Just don't let a diplomat rent a place without signing a contract. Can't have diplomatic immunity from a contract

So much for Diplomatic relations! You would think they would behave accordingly with their title! Terribly unfair and abuse of the immunity clause.

Oh yes. The police can and will stop a crime in progress. The diplomatic immunity is only from prosecution. I tried to become a diplomat to Canada just so I could slap Justin bieber every day... They said no.

I wonder: shouldn't criminal behaviour on part of a diplomat be a *casus belli*, so that countries are discouraged to let evil diplomats roam free?
