I think most if not all Saudi diplomats claim to be royal family member and as such can not be touched even in UAE. They seriously BELIEVE the World exists for them and them alone. If the country wants to have their embassy as they have some business relations- they will get them and trouble which they might bring with them. While a country has a right to ´agree upon´ who is to be send, they will only get offered the royal family members, so there is not much to pick from.

Can you explain why diplomats need immunity from prosecution in order to do their jobs? I've heard the arguments and they're not persuasive.
@hooverkinz5 жыл бұрын
I think the biggest argument would be that they’re pretty high up officials who are in another country permanently, so if the relationship between those two countries go sour, the diplomat could be arrested on false or trumped up charges and the diplomat in custody would be used as leverage to for that country to get their way. North Korea has done something similar by arresting tourists. I still don’t really agree with the immunity, I think if they were charged they should be deported to their home country, there should be an investigation and face charges in their native country if it seems like they’re guilty and be replaced by another diplomat immediately. The reality is though they probably won’t be in much trouble if the charges are true, but isn’t that unfortunately the case for most high up officials anyways?
@acetate9095 жыл бұрын
@@hooverkinz Yes, like I said, I've heard the arguments and they're not compelling. It may have made more sense 70 years ago when information travelled slowly and diplomat's were isolated in foreign countries but the proliferating of high speed communication makes this these laws sound silly. Also, the scenario you're talking about doesn't make sense. If a foreign government wants to go rogue and punish someone these anachronistic laws aren't going to stop them. If relations between two countries go sour than the offending country doesn't have the need to treat foreign diplomats well and can easily find a way to side step immunity laws and retaliate against them. You mentioned North Korea which is a perfect example. They just say an "accident happened" and it's almost impossible to prove otherwise and even if we do prove they're lying how do we punish them? Sanctions have limits to their effectiveness.
@acetate9095 жыл бұрын
@rwsthedemonking Bingo, that sounds like the real reason that you won't find in any state department documents.

@@hooverkinz My reply wasn't intended to be condescending. I appreciate your response and I believe you're correct in your line of thinking. @hooverkinz5 жыл бұрын
Evan Fields no I totally agree! I wouldn’t use what I said originally as an argument necessarily for diplomatic immunity but I think it’s the most reasonable argument. But you’re right it’s very dangerous for anyone to be above the law and what you said is right, they’ll do it anyways and we can’t prove anything. Very well said! Thanks for your reply as well, I haven’t thought a lot about that side of it.

The host country can't prosecute someone with diplomatic immunity but it CAN have the diplomat removed or even suspend diplomatic ties if the diplomat's home country doesn't co-operate. Perhaps should have mentioned that.
@shebbs15 жыл бұрын
Many host countries don't want to go to the trouble of doing this, for many reasons. If the host country is the weaker one then it might not want to upset a more powerful country that may also be an ally. If it is the stronger country it might be pride. Note that countries that protest the actions of foreign diplomats often have ones who misbehave themselves. Removing diplomatic status and suspension of ties can be, and is done, but usually only for very serious issues, and diplomats so affected tend to be lower ranking scapegoats. The diplomatic community sees itselt as an exalted class, but they are well known for abusing their positions.

Although, I think you should double-check the info about not paying rent, because the Vienna Convention on Diplomatic Relations, which regulates the matter, specifically says that the immunity does not apply to a private property if it is not held "on behalf" of the sending State, as follows: Article 31 1.A diplomatic agent shall enjoy immunity from the criminal jurisdiction of the receiving State. He shall also enjoy immunity from its civil and administrative jurisdiction, EXCEPT IN THE CASE OF: (a) A real action relating to private immovable property situated in the territory of the receiving State, unless he holds it on behalf of the sending State for the purposes of the mission;

So what is the rationale for having diplomatic immunity? Diplomats (coincidentally) seem to agree that it would be a disaster if we got rid of it, but is there actual evidence based reasoning behind it?
@tomwebb30815 жыл бұрын
It prevents less salubrious countries from applying "pressure" to diplomats/countries by bringing nonsense prosecutions and essentially holding a diplomat hostage within their jails etc. I can see that not every country is so inclined but if you treat one country differently to another with diplomats that could lead to a diplomatic incident and the expulsion of diplomats.
@rdbury5075 жыл бұрын
@@tomwebb3081 That's the theory, and it sounds reasonable given absence of evidence. But a lot of things which sound reasonable turn out to be completely wrong when you actually perform the experiment. As it stands diplomatic immunity is best known for letting criminals escape justice rather than protecting innocent diplomats. I realize it's a complex issue, and perhaps a more nuanced solution is called for. There has be some middle ground between "everyone gets off scot-free" and "anyone can be thrown in jail for no reason".

For example: If an American in Dubai had an affair with their secretary, that is punishable by law; as it is illegal to have unmarried sex in the UAE.
