Justin Miller represents the family of Rayshard Brooks and spoke after the decision Tuesday to drop the charges against the officers in his police shooting death.
Special prosecutor Pete Skandalakis has said he determined it was "reasonable" to use deadly force by Atlanta Ofc. Garrett Rolfe in the shooting of Rayshard Brooks at a Wendy's in June 2020.
The charges against Ofc. Rolfe - which included murder - and Ofc. Devin Brosnan stemming from the night of the shooting have been dropped.

No. No, actually, they got it right. It was justified based on mister Brooks' actions. Actions have consequences. I'm truly sorry about the whole thing, and feel for mister Brooks, but he decided to resist and run.

PEOPLE, PLEASE! Running from the police is not a felony. Resisting is not a felony. Running and resisting does NOT warrant getting shot. HOWEVER! Grabbing an officer's service weapon is a FELONY! And pointing it at an officer, ANYONE FOR THAT MATTER, is warranted for getting shot. It's called self-defense.

Beating on police is a forcible felony, stealing the taser is a forcible felony, pointing the taser is a forcible felony and shooting the taser is a forcible felony. Thus, brooks committed 6 forcible felonies. In the state of GA, any one of those forcible felonies are subject to deadly force. If you don’t want deadly force committed against you, don’t commit forcible felonies.

However, what people are failing to understand the reason he was shot and killed was NOT that he didn't comply, it was because he had grabbed, removed, and fired the taser. Not complying (resisting and/or running away) alone does NOT warrant an officer to shoot a defendant. Officers cannot do that.

If the courts were opened then it would have been brought grand jury. The courts were closed. With that being said (I find myself saying this a lot), if it did go, it would have been a No Bill. Rolfe is actually a decent cop.

I am hoping Biden will have the DOJ open an investigation. Brooks was 19 feet away and moving further away as he aims an empty taser, that cannot fire, into the air. The family will get justice but they need to wait for Biden to help them.

This guy's leaving out key details. Brooks was passed out IN the drive thru when the police were called. He was blocking traffic. He was passed out because he was heavily intoxicated. So he wasn't going to drive away from Wendy's at that point. The police spoke with him for half an hour before Brooks attacked them. This guy even admits that Brooks "won the fight." During the fight Brooks got a taser and was running away from the officers. The officers only fired when Brooks turned and fired the taser at them. Clear case of self defense. Go find somebody beaten by the police who isn't a serial criminal, p*do, rapist, or isn't actively committing a crime, and champion their cause. I know they exist, and I'm fully willing to oppose abuse of power by the police, but not when the guy who got shot is the one at fault

Maybe you should actually watch the whole video, it sure doesn't sound like you have. And if you did you could easily see yourself in the exact same situation. He talked calmly/respectfully to the 2 cops that just went on & on & on & on for over half an hour. It escalated in about 30 seconds and that joke of a cop Rolfe escalated it. This absolutely should've gone to trial.

There is a lot of pertinent information as it relates to policy, procedure and tactics to go along with statutory and case law regarding use of force so detailing incidents in that manner is for the benefit of those without any training, education or experience in law.

If you don't like the outcome, don't blame the officers. They were working under current police policy, which allowed them to shoot Brooks in these circumstances. Blame the police policy that defines a justified shooting. Work to change the rules of police deadly force engagement. The officers did what they were allowed to do. Change that! Btw- it didn't take so long because it was too close to call, and the investigators couldn't decide. It took so long because elected DA didn't want the case and attempted to recuse themselves, was denied and had to take it to court to get removed. It wasn't until July 2021 that the investigation was assigned to another DA, which started the process of investigating.

Brooks fought officers, took a weapon from one of them, turned and fired the weapon at an officer, and the officer defended himself and returned fire. This was not unlawful or a racially motivated incident. Brooks' criminal actions the threat he posed to the officers are what resulted in his death, not improper actions by the officers.

Any first grader can understand these basic concepts. You are supposed to obey the law and when you get caught breaking the law, you have to face the consequences, which mean, complying with the cops (accept and sign the ticket, put your hands behind your back and go quietly etc...). This holds true for every country on the planet, hell in some countries, he would have been shot a lot sooner.

It was dark when the officer was chasing him..even though he shot a taser at the officer,in that situation a tazer can easily be mistaken as a gun. He was shot in the back ..But if he actually had a gun ,it would have taken less than a second for him to get off multiple rounds without even turning around.. ...The officer has a split second to react.. During that split second that officer could have been thinking maybe he took my partners gun during the fight,or maybe we missed a gun when we were patting him down..

Bruh I’m black and disagree with a lot of cop shootings but I would’ve shot him too. For starters driving drunk is illegal which is why he was being detained/arrested. Second off he resisted and wrestled with the cops and grabbed their taser which is a dangerous weapon. At that point he could render the cop incapacitated and take their gun and possibly shoot and kill them. The only part the cop messed up on was shooting him three times. But you have to ask yourself if you were in that situation and somebody is doing everything they can to stop you including harming you. Would you not shoot them too. Like I said 90 something percent of the stories we hear are cops killing people unjustifiably but this ain’t it man.

I met Rayshard Brooks before because his brother is a friend of mine. He made a bad decision but he shouldn't have died for it. This white lady just shot a cops AR-15 at the cops and they had a six hour standoff with her before they took her in. Different treatment!

The Atlanta police department is already short of officers. The last thing the Atlanta government wants to do is scare them away. Fani Willis has been ignoring the law since 2020 by not prosecuting officers.

The officers were being unreasonable when they denied his request to walk home. This could have been avoided.

Who gets to walk home during a DUI stop? The DUI guy was the one being unreasonable. You are correct, this all could have been avoided if DUI guy would have accepted accountability, then went to jail for breaking the law.

What's the difference between an officer and a civilian when it comes to shooting a another person running away? The threat was over and they could have caught up with him later.It all comes down to the D.A. and prosecutors . Try suing them in civil court.

@@maxsage3362 Max.If you seen the whole incident from the beginning, you would know. The guy fell asleep while at a fast food restaurant. Some ppl have gotten a ride home for similar things. He was polite up until they tried to put cuffs on him. He grabbed a 1 shot taser, not the officers gun. So he ran away and the threat was over for them. Go watch the video. He didn't deserve to be shot in this case. I guarantee you charges would be brought again a civilian, because the threat was no longer there + you chased him down to shot him!

@@maxsage3362 His crime .was drinking too much and driving to get something eat.& Passing out behind the wheel.Have you ever been there? The other crime was resisting jail & court. He wasn't out on a crime spree. Food & go back to the room Not the best choice. But he should still be alive. I'm pro Good Police & Pro Life for the record.

So why didn't he let them put the cuffs on and take him to jail?.. instead of wrestling and throwing one of the officers to the ground and stealing a taser, then discharging the taser at enforsers. I'm pretty sure he'd still be alive if he would have just let them take him to jail. Is your excuse really that they should let every person who broke the law and probably endangered people's lives while breaking the law, go free?
