Brendan is smart enough to ask for a lawyer. No matter how innocent you are, or how intelligent you think you are, ALWAYS ASK FOR A LAWYER, then EXERCISE YOUR RIGHT TO REMAIN SILENT. Warren is the only person who knows that Brendan is innocent, because, IIRC, the two of them were murdering someone else at the time Silas killed one of his victims, which is why Brendan needed Cheryl's alibi.
