The best example of solving marital dispute is when the holy prophet told that husband and wife ; one of you shall be patient ,, the other shall be thankful. Both the patient and the thankful shall be highly rewarded by Allah Almighty. Case closed.

Syed What about if husband fails on his part of fulfilling his duties and his wife out of her concern for their dignity doesn't want to take the matter out of the house? What does islam suggest for her?

Salam Alaikom Sheikh Sayed, I'm not technically a Shiate but I think you have great insight and I like that you open the floor for discussion. It's a hard topic to tackle so thank you for addressing it. I subscribed. I disagree with your interpretation of "Nushuz" as declining intimacy. Married men will know their wives decline intimacy 80% of the time haha lol. Nushuz means "elavation/arrogance/going above the law" in classical Arabic. If you examine the text of surat Al Nisaa up to verse 34, you will not find refusal of intimacy, but rather the following: 1. Consuming the money of the orphan (verse 2) 2. Trying to consume more of the heritage that Allah has ascribed (verse 12,13, 14, 32) 3. Infidelity/Adultery/Fornication (verse 15, 16) With that context in mind "Nushuz" is a woman who is specifically transgressing the above discussed rules. Allah referred to them as boundires (Hudud) in verse 13. You're talking about someone who is going after money that isn't hers and is seeking extramarital relationships. Very serious domestic offences. والله أعلم

Some followers of AhlulBayt from Turkiye addressed this issue in a recent KZbin video. According to their studies/research the arabic word "darraba" (to hit) does also mean to (get) "separate", in conclusion to get divorced.

Yes, it means "to strike" but if you look it's the word in Arabic you use for "hitting the road" or "going on strike." Its figurative like so many things in Arabic. Unfortunately, without the proper guidance a violent man is going to see an allowance to beat his wife in an unhappy marriage when all it actually says is to have a frank discussion, if the problem persists withhold intimacy, and if she doesn't come around then you leave the home, if they still won't change then divorce them permanently. The same surely goes for a woman to her husband, if he's treating you wrong you talk to him, if he doesn't improve you stop being intimate, if things are still bad you go to family or a friend, and if he still doesn't see his error then good riddance.

That said, as he points out, if you want to take it literally it needs to be in the context of the teachings of Prophet Muhammad (s) who was not a violent person and at most suggested hitting someone who caused you offense with a twig in a way that didn't cause injury. The Quran likewise counsels Job to pardon his wife and instead of giving 100 lashes with a rope to hit her once with a hundred blades of grass. A symbolic penalty. When there was a plot against Imam Ali's (a) life, they were caught before they could carry it out. He did not kill them because as he said, they had not murdered him, and it would be unjust to punish them for a crime they hadn't actually committed. His companion insisted they had cursed Ali so Ali simply said then curse them back. Ali had complete faith in the protection and justice of Allah (swt). When Allah (swt) chose for him be martyred he went to his death willingly. The perpetrator was put to death by his successor Imam Hasan (a) as was just.

Misogyny is decidedly unQuranic and was never allowed. If this verse literally meant "beat" why didn't our beloved Rasulullah and Ahlul Bait practically demonstrate the practice..?? Read M Asads footnote on the verse. Dr Ali Shariati and Shaykh Musa Sadr rejected abuse of wife's based on this verse.

Where? What bible are you reading? The bible actually says only abstain from relations with your spouse if you both agree AND for a time to get closer to God. In fact... The Bible states One Man, One woman and if you divorce for ANY other reasons then death or your partner's sexual immorality... If you find another you're an adulterer.

I don’t know why, however something about this is just.. giving a bad feeling. The Qu’ran always comforting, always loving, always kind to its believers so out of nowhere, encouraging to hit the wife just because she is un willing to do the thing is just..idk out of character from the Qu’ran? Wouldnt it be better to just divorce the woman if after constant talks about the matter she is un willing to rather then resorting to violence? I feel like there could be a better explanation.. Allah knows best

A husband cannot beat his wife even if he believes her to be unfaithful. Not even if he catches her in in the act. If there is an accusation of infidelity it has to be investigated and judged appropriately. Then it is up to the court to administer the appropriate corporal punishment, not her husband. For example, if a woman is blackmailed or coerced by her boss into an affair, she may be unfaithful for not telling you, but she is not criminally liable. If she seeks out an illicit relationship with her boss to curry favor, I might argue this is more similar to the idea of a servant or slave committing adultery and the penalty should be halved (although that's for a judge to decide). If she is simply cheating on you with another man independent of her livelihood out of lust or spite rather than seeking an honest divorce, then she would be subject to the full penalty. But the full penalty for sexual misconduct is a lashing, not a stoning. Respectfully, the Iranian government does not follow the Quran and Ahlulbait.

If I’m correct it had to do with a promise I think Prophet Noah made? It was some promise by a certain prophet and something happened where he was unable to fulfill his promise to God and so had to ‘beat’ his wife, all he did was gently stroke his wife with something. And God counted that as beating. That’s rather revealing in it of itself.

Who beats the husbands for their violations? What are the consequences for men? Men don't always take on responsibilities. Sometimes, it could be she is worn out after 4/5 children, looking after his family too. There are many other reasons.

Honestly, we need to say the meaning as is.. If it is beating that's what it is. Better than wives raising a child as a single mom for the whole life and sleeping with others to fulfill her needs. We need to really wake up to see what's going on in the society. These are the words of God and rest assure he talks with authority which not everyone is going to like weather Muslim or non Muslim. Can't have an apologetic approach towards this ayat which is potentially saving a marriage.

Accusing women of such things lands you in big trouble dude. You need proof and you definitely cannot make sweeping claims like that against Muslim women without proof. the punishment for such accusations lands you an immediate death sentence. If you cannot even make accusations the heck you think you have reason to beat, I’m sure God or your parents have reason to beat you, yet they aren’t. You are not some special class of organism

Firstly, this verse is not about a woman sleeping with others. Secondly, the Quran has to be understood through the words and Seerah of the Prophet and his progeny. Else, we will be migrating (Wahjuroo) as part of the second solution :)

Islam calls Jesus a prophet, and says that other than being God on Earth the bible is moslty correct. Please explain the contrast between the words of Jesus in Ephesians 5:25. The Quran and the New Testament are so far from each other I cannot comprehend how you think they come from the same being. You say Peace Be Upon him... But reading of the one you declare a prophet. I see no peace, I see a warlord, a violent sexually immoral man who condones taking the wives of your enemies as sex slaves when Jesus told us to love our enemy. How can you say Jesus was real and a prophet while his messages were the exact opposite? I am legitimately trying to understand because I have felt the peace and love of my God I have felt the Spirit enter me and transform me and what is contained it that book... doesn't match.
