Hi thanks for the J-1 visa info! It was super elaborative. I have a question on my J-1 visa: I went to the US with a J-1 visa over the summer of 2022. I am subject to the '`two year homestay requirement' as the notation on my passport reads it. However I decided to terminate my program two weeks after its start date and I went back home right away. It was a 3 months long program. My program providers told me that I will be subject to the two year rule and I understand it. However my J-1 visa was a year long. It expires in August 2023. My question is: can I travel back to the US with that J-1 visa since it's still valid? and if you have time, I would like to know if a waiver application is possible since I did not complete the program. Hello. I'm glad you liked the video! No, you will not be able to travel on the J-1 visa you have as your J-1 visa program has ended and your SEVIS record is shortened as well. Without a valid DS-2019 form, you will not be able to enter the U.S. on the J-1 visa that you have. Yes, you can still apply for the waiver. Good luck!

I don't specialize in green cards, but I do believe you would need to wait for the entire 2 years or obtain a J-1 waiver before starting the green card process. You should consult with an immigration attorney that specializes in green cards. Good luck!

The 212(e) was initially attached from the Fulbright program. If I were to apply for a waiver, do I need the No Objection Statement from both my former sponsor (Fulbright) plus my current sponsor(home country), or do I only need to provide NOS from my current sponsor? Hi, I just finished my J1 visa trained program in the USA. My schedule was extended, so Instead of 12 months, I did the program for 18 months. My question is that my visa stamp said I am subject to the two years, but my DS 2019 said I am not subject to the two-year home requirement. How do I know which one is correct?? Hello Walder, since you have conflicting information on your documents, you can ask for an Advisory Opinion from the Department of State and they will inform you if you are subject or not. Hello Monica, if you just finished a J-1 visa internship, you will have to wait 2 years before you can start a J-1 visa traineeship. But this is a separate rule that is not 212(e).

However, you talk about another two year stay at home rule. Will this apply to me? Would I be able to participate in another J1 program such as J1 teacher, camp counselor or intern after I complete my 18 month traineeship or is this other two year stay at home rule uniform for all trainees? Hello Andrew. As you mentioned, you probably wouldn't be subject to the 212(e) rule as you mentioned, but make sure to check your DS-2019 form and your J-1 visa once it's issued to confirm. You must wait 2 years if you wish to repeat another J-1 trainee program but don't have to wait if you wanted to do a J-1 intern program.

Hi Avery - Thank You! Using a J1 Visa I entered the USA in Nov 4, 2022. I was told at the port of entry that my immigration status was inactive because I was late for the J1 program. I returned to my country on Dec 3, 2022 in Good standing. Recently I was refused an F1 Visa at my interview, reason being that I'm subject to 212(e). Even though I didn't participate in the J1 program due to invalid j1 status upon arrival, am I still subject to the rule? If yes, should the 212(e) be a reason not to acquire an F1 visa? Thank you!

Hello. You should speak with your J-1 visa sponsor to get a record of when your J-1 visa status went inactive. If you were in the U.S. for a minimum of 1 day in J-1 status, you could still be subject to the 212(e) rule. The 212(e) rule doesn't apply to F-1 visas. Good luck!

Hello. If your husband's J-1 program is still valid then your J-2 program should be valid too. You will need to ensure your DS-2019 is up to date and has a valid travel signature and your visa is still valid. As long as his program doesn't end, yours won't either. I hope this helps.

Hello. This is an example of indirect funding since ultimately the funding source is NIH, which would be government funding even though you're getting paid by Harvard. This will probably subject you to 212e.

My primary sponsor is Intrax Inc. which is an international company, and my DS-2019 letter was issued by this company. In my DS-2019 letter, my source of funding is mentioned to be Brigham and Women's Hospital Inc. + personal fund. This is all that is mentioned in my DS-2019 letter. However, I found out that my supervisor at BWH inc. is supporting me through NIH funding, but there is no mention of this in my DS-2019 letter. Yesterday, I also contacted NIH to see if this could be counted as indirect NIH funding, and they responded that I needed to reach out to my sponsor (Intrax inc. in my case) as my DS-2019 was not issued by the NIH. Due to this response, I kind of gained the impression that my case was not counted as indirect funding. I then reached out to Intrax Inc. to ensure this, but they did not provide me with a clear answer. They just said that they could not advise on these immigration inquiries. Considering the above clarification, do you still think this is an indirect way of US government funding and I will probably be subject to 212(e)? Thanks!

Yes, you're permitted to travel to other countries. If you are subject to rule 212(e) you must remain in your home country for 2 years before you can apply for an immigrant visa. You could obtain a waiver to not be subject to this.

Hello. In general, your home country is the country of citizenship that you applied for your J-1 visa with. If you have changed your citizenship after your J-1 program, your home country will probably be your first country of citizenship before the change.

@@BobCao There are other types of waivers besides the No Objection. If your government won't provide you the no objection letter, then no, you won't be able to get this type of waiver. Visa to go to your own country of citizenship? You should be able to return with your passport. If you're unable to, then no, you will not be able to fulfill the requirements.
