Yup, PLANNING. I would suspect that many of the unfortunate cases you alluded to involve large discrepancies in net worth between the members of the couple. For the high net worth member, marriage is a high-risk, low reward proposition. IMO, it's unconscionable for the HNW member to not plan for their potential early demise and initiate the process of estate planning.

Isn't there a rule that a nonspouse inherited IRA is not subject to 10 year drain if nonspouse if less than 10 years younger?

I believe that to be true. I set up an IRA whose sole beneficiary is my widowed sister in law. She is 3 years younger than me. I fell into widow trap when her sister (my bride) died 3 years ago. I created that IRA shortly after her sister passed. I do believe the account needs to remain separate from her own IRA, but I believe she can take out funds over her lifetime. RMDs probably would have to be calculated based on the sum of her account and the inherited account. Her two adult children are contingent beneficiaries.
