Isn't it funny how many of these great benefits the VA fail to mention.... been at 90% for years, unable to work, and never ever head anyone at the VA at any of their locations, on the phone, email, etc. mention anything about TDIU to me until last week, only because I am appealing their decision on my ratings.

@Buck VA does not promote duty to assist, once you became 90 percent the VA were supposed to offer you TDIU. But obviously they want you to apply and take forever to grant you 💯

In my case, it went back to the date I was considered to be disabled enough to qualify for schedular TDIU. This was after my last date of employment by about five months I filed the supplemental claim a few months after I stopped working. It came back with a weak rating, with I asked for a HLR for. HLR got me up to 70%, which qualified to apply for TDIU, and when THAT was granted, it was back-dated to my supplemental. This leads me to think it's the date of the claim, not the date you couldn't work anymore. Hope this helps.

I am 90% rating. Virginia Veteran Affairs office submitted my unemployability claim 3 months ago. The last contact was a month ago via phone and they said waiting for Social Security to return if any disability claims through them.

I’m rated at 90% with the VA and 100% through SSDI. Is it possible to apply for an increased rating and TDIU at the same time , and if initially awarded the TDIU, can a Veteran still be awarded 100% total disability. Would it slow the process considerably by applying for both?

Im 10 percent for Tinnitus, 40 percent back, 70 percent for PTSD. 120 percent. Combined rating of 80 percent. All dirct services connected. Nothing in my notification to file for TDIU.

As for our staff. Claim up to 3 years. Plus. Benefit we give. Make sense on the long run. -------- As for veteran of the federation. We have data from previous era. I make analyse. It may be possible to work with younger cadet. It help for the soul to stay active and be with youth. That way. Benefit could in theory be higher due to compensation for pay. However. I do understand that physical injury can be an issue. Work from home is the best possibility. As for mental injury. To be honest. It never fully heal. Takes time and effort. I can send initial data and wait for decision. Based on individual case. We see what happens. *Part-time work* to teach.

So what if I work in a protective work environment but they still don’t give me hours when I miss work for my service connected disability’s but they don’t fire me and let me come back to work?

I had a major PTSD issue leading to hospitalization in June 2021, I did work for a total of 3 weeks with one employer in April this year, and was terminated due to a policy violation caused by a Panic Attack. I then worked for one other week in June 2022 and quit due to a Panic Attack. I have a Service Dog to help mitigate my PTSD and many employers are not able to provide a reasonable accommodation for the dog. This has been a major hindrance. Can this information be beneficial in a TDIU request? Working with VA Vocational Rehab, I did attempt to apply for about 50 jobs, and have not had success even getting hired. Does this impact my decision?

For protected work environment qualification, what about a veteran who is an owner operator truck driver because they cannot work in an environment where there are other people involved?

VA will now use a "data wage match with the SSA" to identify Veterans in receipt of IU who have earned wages above the poverty threshold. The VA will now only send a VA form 21-4140 and due process letter, to those veterans identified in a wage match.

In other words, if you work and pay taxes, the SSA reports to the VA and you'll get a 4140. Just be smart.

Under 38CFR4.16 also states in section (A), the last sentence in this paragraph: "For the above purpose of one 60 percent disability, or one 40 percent disability in combination, the following will be considered as one disability: (1) Disabilities of one or both upper extremities, or of one or both lower extremities, including the bilateral factor, if applicable, (2) disabilities resulting from common etiology or a single accident, (3) disabilities affecting a single body system, e.g. orthopedic, digestive, respiratory, cardiovascular-renal, neuropsychiatric," Doesn't his will also meet the qualification for the 40 percent, total 70 percent rating?

To apply for TDIU, veterans need to fill out VA Form 21-8940: Veteran’s Application for Increased Compensation Based on Unemployability. The form asks for information, such as: The nature of your service-connected medical condition that prevents you from maintaining substantially gainful employment; Whether you have been hospitalized or under a doctor’s care during the past 12 months; The date you became too disabled to work; Your employment history for the last five years you worked (It is important to note that VA requests information on the last five years you worked, not for the previous five years. If you have not worked since 2010, you must give information about your employment from 2005 to 2010); All education and work-related training you received before and after becoming too disabled to work. What 12:25 failed to mention is that when you reach your SSA full retirement age, for me it’s 67, they remove the TDIU because there is not reason to be employed at this point. TDIU is not for life.

If an individual is 100% TDIU, how does that individual go about obtaining a protected work environment status? What if the individual can only work as self-employed due to their medical conditions, to include 70% PTSD and other health ailments and not worry about going above the $12k minimum income level?
