If he's still operating under the same business name, you can file a Lien against his business property. And depending if you sued him personally, you can put a lien on his personal property too. A judge will sign off on this, and the sheriff will assist with executing collection of his property

Assuming the property isn’t exempt, you know what property he has, you know where it’s located. A dishonest person like this probably has little to nothing or has it in somebody else’s name, hidden or another way to protect it. He probably has several others trying to collect from him as well.Unfortunately the only thing you can count on is Karma getting him.

In my experience the best way to eliminate your water issue isn't cheap. I would recommend doing a wider and deeper ditch in concrete around the shop with correct grading . This should drain to a large drain basin/ tank with proper volume sump to discharge. Then install steel grating over ditch lines. Hope this helps . Your a good guy and sucks to see this happen to you .

it's not even about him continuing to work on other's buildings. it's the fact he didn't care to correct any of his mistakes. Honestly, we're all human, contractors im sure make mistakes or oversight or things happen. but the right thing to do was to fix the problem and make sure that the customer was made whole again. customer service is always top priority.

Put an in ground drain infront of the shop in the concrete, slope it properly and leave the top grated/meshed it’ll stay flush this way for the cars but get the water out of the front. I just had one installed infront of my house and driveway because of flooding

I say worst case scenario go to the better business bureau, it won’t actively get him in trouble, but any clients or other customers WILL see anything reported to them and the only way to get it removed is for both parties to meet and resolve any disputes.

No matter what upgrade you do to the french drain , you are gonna have flooding issue , with that slide of the terrain the shop should have been build higher then the the lowest point of the slope and the french drain lower then the shop , the solution would be a retaining wall with a french drain on the outside to a big collector tank and gutters to help with anything INSIDE the retaining wall ..anything besides that is just kicking a dead horse.

Might sound dumb but have you looked where it leaks in from? Possibly add some lead flashing or damp proof course to the bottom of the workshop so it can’t leak in while it waits for the drains to pump the water away.

it literally comes under the entire back wall. usaually heavier from left to the right of the shop. I can tell even tho he had help in the regrading. it still needs to slope away from the building even more. normal light and event up to heavy rain. he's ok . but its the flashflood downpours that he gets that it cant drain fast enough.

Evan, have you considered contacting the TX Attorney Generals office to submit a consumer complain? At least put a complaint under the defendants record. There’s also Google reviews and BBB. I did this as I was in a similar situation with our home. Hired a contractor that screwed up things especially with drainage and our foundation. Managed to settle after the attorney general got involved. I’m assuming this guy your dealing with is protected by an LLC. If he doesn’t have business insurance you should be able to go after business for their assets to compensate you. Can’t garnish wages but there’s definitely something you can do.

Dude, the only way to stop the storm water is to install an open top box culvert around the perimeter. I think who ever designed your shop never considered drainage. Even your slab between your shop and house should be connected to storm water too. There a lot of work to fix your drainage issues unfortunately.

Collecting on your judgement will be a lot harder than winning the lawsuit. Unfortunately he probably doesn’t have anything that isn’t exempt from you taking it. I would assume he’s self employed so you won’t be able to garnish his wages and being in Texas he’s exempt from garnishment. Unfortunately you probably would of been better Off not suing him at all because now you are out the legal costs as well which aren’t cheap. He can always just file bankruptcy on your judgement as well. Unfortunately only 20% of Judgements are satisfied in the US and it sounds like yours is part of the 80%. Karma will eventually get him.

On paper...yes. BUT. It's not necessarily about the money. It's about doing the job you were hired to do. Standards. Look around you. In today's world, what's a man's word worth? What level of accountability do you expect. How many times are we going to "let things slip by" without holding people accountable? Evan doesn't remember this. But I've "known" him since he was tottering around in diapers. His dad and I go way back. I know this young man is firmly rooted in traditional values and standards. A civil society exists due to trust, respect, and doing what you say you can/will do. That's how this man was raised. And God bless him for it!

@Boru I'm not qualified to give legal advice. Nor is anyone on here except his legal counsel. My point is that we, as a society, have given up holding people accountable. There will come a point where we have to say "enough! I'm not rolling over and letting this go!". It seems obvious now that the construction was not surveyed correctly. The foundation was set too low for grade. And adjustments were not made. That's culpability on the contractor. Every time it rains, time working is lost to fix what should have been correct in the beginning. Equipment exposed to water that could reduce its work. Possible electrocution... The contractor should at least be held liable to the necessary additional improvements to drainage or regrading the surrounding area. Again, no one on here is capable of giving legal advice except HIS attorney. I'm just showing support for a young man who's working hard to provide for his family and viewer base. If his decision is to pursue legal action, I applaud him for not being victimized by a shotty contractor.

From a professional perspective as a commercial/multifamily general contractor, we have a whole layer of default insurance on every trade partner we do business with on our projects. That simply didn't exist (or have to exist) 5 to 10 years ago. It is really frustrating that we have to spend money (hundreds of thousands annually) to insure ourselves against what boils down to shitty human beings that may never be punished for their mis-dealings. That also doesn't account for our pre-construction time vetting all these fly by night contractors who do hundreds of thousands, sometimes millions, in work every year essentially out of the back of a pick up truck. We joke that if we sought litigation on every broken contractual obligation we'd only have a parking lot full of white work vans/trucks to show for it. I feel your pain as a property owner as well. Dealing with liars sours your perception of humanity a lot. But if I had to offer a silver lining, (although very thin) it gives you a profound amount of experience at the end of such ordeals and you also develop a strong relationship with those partners who do step up to the plate to clean up the crap others leave behind. Those are the guys and gals you keep on speed dial. Love your videos and best of luck with your growing family. 👍
