you made the claim that expressed claims must be followed exactly. But your first example uses an expressed condition, and you said it doesnt have to be followed. So iz confused

I could be wrong, but I think the first hypothetical is an example from the Jacobs and Young pipe case. The court there held that the use of a different pipe was not an express condition in the contract because the party didn't use clear conditional language. Same thing here.

A lot of Blah, Blah, Blah nonsense like most law school lectures. Translate into English, show examples, and then all the Blah, Blah, Blah nonsense becomes concrete. Like almost all law schools, lectures operate in a vacuum.
