Sir agar patni date of separation hi galat bta rahi hai toh 340 lagegi ke nahi maan lijeye patni 2011 main ghar chod kr chali gai or pati ne 2018 main divorce file kr deya or patni ne 2019 main 125 ka case file kr deya 2023 main patni ek affidavit deti hai usme date of separation April 2022 bta rahi hai toh keya uspe 340 lg skti hai

Sir mai dv case mai bina reply & income affidavit diye apke kahe anusar discharge application diya judge ne suna aur order kiya ki abhi kuch nhi hoga trial stage mai dekhenge fir mai session court appeal mai gaya section 29 mai but itne mai hi lower court ne 12000 interim lga diya 2k bacche ka & 10000 wife ka ab kya kre mera income bs 25000 hai aur wife ne uske income affidavit mai Mera income 80,000 bataya hai... pls reply

Sir ladki ne 6 mahine pahle PNB mein account open karwaya or apna post office ke fd ka chq waha se cash Kara ke account band karwa diya but usne apne income affidavits mein na hi pnb ki jankari di or na hi post office account ki, or court mein statement de diya ki mera present mein pnb or post office mein koi account nahi hai, or ladki ne pichle job se transfer le kar kahi or job karti rahi par court mein bola ki meine job chod diya hai , kya ispe court koi action lega, ya ispe koi action banta hai

My wife has a mutual fund investment of around 10 lacs which she didn't declare in her income affidavit but the bank statements she attached with the affidavit are clearly showing ECS being deducted every month. Which means she herself proved that she is lying on auth. Can I file 340 in this scenario?

सर,plz replay मेरा फॅमिली कोर्ट से डिव्होर्स हो चुका हे. बिवी ने maintanse की माग के लिय पहिले से उसके मयके से केस दाखल की हे, अब तक maintainse की order. परित नही हूआ है. याने case pending हे. लेकीन बिवी अब काही तो जॉब कर रही है ओर उसने चुपके से शादी की हे, मगर उसका कोही पुरावा ,(evidanse) नही मिल रहा. अगर Maintanse की ऑर्डर के बाद , पुलीस चौकसी ,(police enquari ) कर सकते है क्या नही ?? उसके स्टेप्स कैसे है क्यूकी पुणे में रहती हे,

Sir, I have query I have filed an application under section 340 read with 95 CrPC in family court where my contested divorce case is at arguments stage … family court registered Misc Case and issued notice to opposition. As per my knowledge any court - civil, criminal & Revenue court where matter is pending have jiluridiction to initiate 340 if application submitted by the party. Inquiry will be proceeded though opposition do not have right to heard & enquiry scope is limited if offence is committed or not based on evidences available on record; basic this court will if satisfied will order to register the complaint to the magistrate having jurisdiction & trail will conducted in magistrate court …. Is my understanding correct? ( I researched this topic & sections in detail as people are confused about this & not aware where to what) Please throw some light On the contrary you mentioned that 340 will be filed in front of the magistrate & he will order for complaint which do not seems correct please verify this information please.

Hello 👋 respected sir, very nice information given by you about law relating to 340cr.p.c. Sir I am a plaintiff in service matter case,and defendant who from punchkula send a affidavit with sports of department written statement,the local officials submitted it court without signature of oath commissioner, only a round seal of oath commissioner and date of present before oath commissioner,local officials who submits this document in court, identify the officer who given written statement and affidavit,even large size stamp and registration number was not on the affidavit, and signature of oath commissioner not on affidavit,even it was given in court. Later on,on cross examination the defendant witness who was also the same ,who gives written statement and affidavit and signature on it says that he was not present on the very day when the affidavit and written statement given to court,he was on duty at punchkula, Now the question is that the official who identify the defendant before oath commissioner,and oath commissioner not attested the affidavit and registration number as per law,then is this local officials who submits the same, should not be found to procecute to tender a false, and fabricated and incomplete documents before the court in civil services matter case. Please let me advice about what should. May I file a application before that sub judge,or file a complaint against the local official who identify the defendant witness who was not at all the time here, before oath commissioner or in the court.

My wife has filed 125 crpc, although she left out of her own wish alongwith my gold worth 1 million. She sent daughter to her parental home a day before she left. On the very 'next day', notice was issued under 125 crpc directing me for appearance in the court. It was all pre planned. Now she filed case in tehsil court which is out of jurisdiction for both of us. She has manipulated her address so that her case is admitted in the said court. She mentioned in her petition that my parents & 'Sister' used to harass her although we were living separately away from home. Now fact of the matter is I don't have a sister. She mentioned I used to fight with her 'Father' & brother. I haven't seen her father as he passed away probably a decade ago before our marriage. She mentioned I am a government employee drawing 1 lakh salary. In the next para she mentions I m a businessman earning 1.5 lakh profit on top of salary. Fact of the matter is that I m a private employee working in my retired fathers shop & I was never a government employee. I submitted Assets & Liabilities form, income certificate from employer, Income certificate from Tehsildar(Executive Magistrate) in the court. After we filed objections & verbally exposing them in the court, they requested amending the petition & hired a new counsel who blamed previous counsel for these lies. Although she has given statment under oath. I protested that petition should be dismissed as its fake n frivolous & ammendment should not be allowed as it changes the basic nature of the petition. These are non curable things. However recently I came to know that they have been allowed fo file revised petition last year without my knowledge. Afterwards magistrate got transferred & new magistrate arrived. The new magistrate without even ascertaining the case details pressed for maintenance & ultimately issued her interim maintenance & that too more than my salary. Now can I file 340 crpc against her. Their entire case is based on lies. In one instance she has mentioned she brought dowry & in the very next para she says we harrased her for dowry as she didn't bring dowry being the daughter of poor widow.
