Sir mai 2013 se alag reh rhi hun pati aur nanad ke dwara 8 month ke bete ke sath mayke pahuncha diya gya tha wo bhi adhmari halat mei ..2015 se 498a ka case aur pati ne divorce case kiya 2016 mei maintanence ka case hua aur 2016 mei hi dusri shaadi kr liye 2017 mei 494 ka case kiya h beta 11 saal ka ho gya kisi tarah ka koi maintanence nahi dete aur property hone ke baad bhi court mei kehte h ki mere pass kuchh bhi nhi h ...aur aaj bhi wo aur unki behane mentally tourcher krte h phone pe dhamki gaali ghar bhi aake dhamki dete h ... sasural mei apartment ghar bahut zameen h kuchh nhi dena chahte yahan tak ki dahej ka paisa aur sara saman bhi nhi lautaye ... property details kaise nikalu..khud ke liye kuchh nhi chahiye bas bachche ko uska haq mil jaye

According to supreme court . Trial court cannot order interim order of maintenance without hearing other husband points . Husband have done case section 9 case before ur wife done against u. If u done section 9 case after the dv act then u will not get any relief. U have strong faith on God that god will help to bring ur wife back. Never act on advice of advocate when u have strong against ur wife . That will help u to bring ur case strong . No advocate advice to target ur wifes parents. But remember one thing if u want to win ur case then give maximum prof against ur wifes parents. Then wifes parents wants come to u how to do settlement . In ur statment allways say u want to keep ur wife . Bcz god has make ur wife as ur life partner. By the blessing truth will come in front of every body .

What happens when an estranged wife is living alone peacefully past 5 years. And then files DV. Also when she's educated and 498a and Divorce is going past 5 years. Q. Please reply 🙏🏻

Legally she can file cause it's a civil remedy and there is no limitation....but since there is so much delay so her case will stand weak....

Court doesn't pass any judgement . Court cannot pass the judgement . As court have to hear husband . Only that husband have to tell that his wife parents and relatives created the problem and destroy there life . Do not fear in dv . When wife demand that she wants to live in her in laws then say the court u have not thrown away ur wife . Generally cannot declare ex party . Court has no right to seperate from his wife . Husband can sell his property as husband has right to sell his property . Wife cannot claim the right throw dv act accordingly to supreme court . This advocate is making fool . Court cannot give order till the court not hear the husband . Husband have to faith on God . Husband have to tell court that no police investigation occure against him then how court could run the case according to supreme court rulling
