@PorchligtLegal Family law attorney here, and I absolutely love this. I’m saving it in my back pocket for all of my clients who could use this peptalk, even those with contested divorces because it contains a lot of great non-legal tips about how to think about moving on.

Thanks! Keeping conflict down, even in contested cases, makes the whole process much less stressful.

Married just over 7 years, in our 50s. We filed for divorce last week, 9.3.24. Uncontested; no joint assets, liabilities, bank accounts, or children. $10 for the papers, $28 to have them notarized, $218 filing fee. Court date 10.29.24, which neither of us will need to be present. Afterwards, I go get a certified copy and then I can start getting my name changed on everything. Edited because I had put the final date in incorrectly 🤦♀️.

The no dating part also includes couples who are married but haven’t seen each other for over 10 years and made their lives on separate states, different friend circles, etc? Basically they are strangers to each other. No kids from that couple but kids outside perhaps. Nothing shared financially. No house, no car, no savings.
@porchlightlegal5253 Жыл бұрын
It's generally best for people to complete the divorce process before they start dating. It's also generally best to finalize the divorce before spouses have been separated for many years and become total strangers--marriage still ties people together legally. That being said, there may be reasons that neither of these things make sense for your case. You should consult with an attorney if you have any concerns

Mistakes: 1. Dating 2. Using social media 3. No plan for future 4. Not Paying attention to $$$ 5. Not Improving your job/career 6. Don’t bad mouth your spouse 7. Being stubborn

Divorce is a stressful process, which can sometimes make it easy to slip into bad behavior! Having an attorney to guide you through it can help you keep perspective throughout the process.

If a spouse is a victim of domestic violence are there special documents that should be filed or should it be mentioned in the complaint for divorce?

@Elezabirth Cotter This woman put a gun to my face and threatened to kill me after I caught her cheating AGAIN..lol…The only way Dr. Williams can help me is if he can finalize divorces🤨🤨
@ComedianTonyLove2 жыл бұрын
@Elezabirth Cotter I wonder if a man is given the same benefit of the doubt when he is abusive towards a woman. “She must of done something to cause him to be abusive.” I just wanted to see if it’s likely a man would receive damages for defamation and trauma. But I guess the answer is not likely. There is no way I would ever give anyone a 2nd opportunity to kill me.

If there’s no child and property in uncontested divorce, does a financial statement form is required.
@porchlightlegal5253 Жыл бұрын
Most counties require a Domestic Relations Financial Affidavit (DRFA) to be filed as part of an uncontested divorce, even if there are no kids or property. The requirement is not always enforced, particularly if at least one of the parties has an attorney.

The court requires legally sufficient service in all cases. In uncontested cases, the Respondent signs an Acknowledgment of Service rather than being served by the sheriff or a process server.

I think family lawyers are a CANCER on society creating mental issues in children through conflict, a stream of future criminals or people dependent on social services in adulthood, parental alienation, the second highest cause of personal bankruptcy and increased suicide risks for children and men I would say 95%+ of relationships are contested, mine broke up and had a lawyer already so contested it is... As soon as lawyers are driving the process it typically devolves into conflict because there is very little money for lawyers in uncontested divorces... I.e. $2k instead of $10k - $100k's, most will end up at a min of $10k-$50k each, which I think is a complete waste of money for the damage it inflicts to everyone I've met only one person who managed a cheap uncontested divorce, most had legal battles or even false DV claims thrown in as toxic negotiating tactics Usually it comes down to the woman's feelings and selfishness...which blow up relationships 70-80% of the time

Can you have an uncontested divorce when having a child?
@porchlightlegal5253 Жыл бұрын
In Georgia, an uncontested divorce means you agree on all terms of the divorce. This includes custody and child support if there are children
@attvcks_media1619Ай бұрын
Why would you date anyone while getting a divorce? It’s a bad omen!!!!!!!
@porchlightlegal5253Ай бұрын
New relationships while a divorce is pending can certainly create issues between the parties. For someone interested in dating right away, an uncontested divorce is generally a great option for reaching a faster resolution.

How to prove a husband abused you emotionally and psychologically as well?
@porchlightlegal52532 жыл бұрын
Each party has the opportunity to testify and present evidence at trial. But going to trial is expensive and takes a long time. You might be better off negotiating a settlement with your spouse. Given the power dynamics that can occur in abusive situations, you should talk to your attorney about the best strategy for your case.
