New Mexico State police were called to assist a captain on November 4 who reported someone trying to pull him over on I-40. “He turns on all of his lights - blues in the front, reds in the back - just trying to control traffic and act like a cop,”
Officers tried to place Portillo into custody. Once detained, Portillo has an explanation for what he was doing. “We go to Central and Eubank and we just run all those all the way down the hill. I didn’t light him up. I didn’t do anything because that’s against the law to pose as an officer. I’m a PPO for the state. I work for this private company and we’re cleaning house here,” Portillo says.
Portillo was given a misdemeanor citation for impersonating an officer and released.

I had a neighbor that was a simple park security guard. He literally was just supposed to keep an eye on the public bathroom at a playground. Guy would get suited up in combat boots, Bullet proof vest under a full tactical vest, professional black tactical cargo pants and a heavy duty utility belt loaded with enough gear that it would make Rambo embarrassed. He'd get so upset because the only thing he legitimately needed for this terrifying job was a yellow and orange reflective visor. He got let go after a couple of weeks because he was scaring the shit out of the kids and parents just being there staring at them in this ridiculous SWAT team costume. If the cops had no evidence he did anything wrong, he wouldn't be required to identify himself at all. Additionally, he's only required to identify himself. Not to hand over a driver's license. He already identified himself and therefore complied with the law. The arrest was absolutely not legal under those circumstances regardless of what else the suspect might have done. This makes the cops guilty of false arrest, assault/battery, perpetrating a hoax, and probably a few other crimes they'll never be charged for because of how corrupt the justice system has become. Further, I don't even see a statute in New Mexico that would make the above true. There's only a statute requiring him to not actively conceal his identity by pretending to be someone else, or to not be himself, which he clearly didn't do. If he'd been involved in a traffic stop, there might be validity to demanding a driver's license then, but the cop did not articulate that. He articulated that the investigation was about impersonating a cop, which has nothing to do with his driving record, even if the crime occurred while driving.

It’s just highly frowned upon for them making arrests outside their work areas when on duty unless it’s absolutely prudent. It’s called a citizen’s arrest. It’s a lawful ability recognized for property owners for a very long time. Moreover, when you’re arrested on private property, even if said property is open to the public, the property owner or their representatives (security) don’t need a warrant or even probable cause to search your possessions. Let that sink-in should you get your jollies off on demeaning a lowly “guard” because you think you’re a street lawyer. On their properties, they in essence have more authority, or perhaps better stated…permissions, than the police do. What hemmed this guy up is doing illegal activity on a street or highway, going to his work property, & then being under the belief that he didn’t have to comply. If that was true the cops would have arrested him, taken him down to the station and booked him. They released him after detaining him. They also said he is doing a good thing as a private protection officer. They had specific concerns in a gray area as he does not have, "Police," listed on his car or uniform. They believe he impersonated a police officer when he flashed his lights on the highway, but they released him with a court date. They never said he is dangerous in the video.
