This contradicts fundamental principles of international law and the positions of the UN. A takeover by Israel or the USA would be illegal for the following reasons: 1. Israel's lack of sovereignty over Gaza - Israel left Gaza in 2005 and no longer officially claims sovereignty over the area. - Nevertheless, Israel exercises de facto control (borders, air and sea space), which according to the UN still constitutes an occupation. - A renewed direct annexation or takeover would be illegal under international law. 2. The USA has no territorial claims - The USA has no basis under international law to take over Gaza or install a government there. - Such an action would be an illegal occupation and annexation. 3. Violation of the right to self-determination - The Palestinians' right to self-determination is a recognized principle in international law. - Neither Israel nor the USA may unilaterally determine the future of the Gaza Strip. 4. Forced relocation = crime against humanity - The forced relocation of the Palestinian population proposed by Trump could be considered ethnic cleansing or deportation. - Such measures violate the Geneva Conventions and the Rome Statute of the International Criminal Court (ICC). 5. UN resolutions and international consensus - The UN recognizes the Gaza Strip as part of a future Palestinian state. - The two-state solution remains the recognized framework for a peace solution. - A US or Israeli takeover would violate all UN resolutions on the Middle East conflict. A takeover of the Gaza Strip by the USA or Israel would clearly be contrary to international law. Trump's proposal and Netanyahu's approval ignore the current rules of the international order. If this plan is actually implemented, legal action by the International Court of Justice (ICJ) or the International Criminal Court (ICC) could follow. In addition, massive diplomatic and possibly military resistance from the Arab world would be expected. This proposal therefore seems not only politically unrealistic, but also a blatant disregard for international law.
