I'm a combat engineer vet and they followed an unlawful order. Following orders is not an argument for any defense.

Yep, they'd actually be in more legal trouble for it too. It came down from the top, not only did they follow an unlawful order they violated a lawful one in doing so.

In the History of the Military, No Service Man was ever Convicted for "Following the CO's Orders", But Quite a Few were for "Disobeying" Orders.

@@kurtjk01 That was a political farce, not a real court. don't ever pretend that was in pursuit of justice or fairness. Every single one of those non-high ranking nazis punished had the same exact defense as the forcibly conscripted occupied forces (pols/slavs, so on) - following orders AND self defense. failure to serve in the nazi military state as a german would result in being a traitor and killed. When you are in wartime AND the military exercises the code "obey or be shot in the field" then following orders as a defense is EQUAL to self-defense. Disgraceful the nazi infantry and NCOs weren't grranted immunity. Only officers (in most militaries) are given the authority to question/defy superior orders if it risks missions/rules/objectives; enlisted cannot and NCOs at most can question the order by going to the next superior officer (but if reaffirmed, they don't have the authority to refuse, especially during war times). the nazi foot soldiers absolutely were justified in their defence, just like all the occupied ones who fought "with the nazis" because "they had to" and were let off. The only reason they tortured and executed the nazis at nuremburg was because they were trying to desperately force anyone who knew the location of hitler (who likely escaped) and several of his high ranking officers (who absolutely did escape). sadly, the rank and file and low-ranking officers almost assuredly had no clue about their escape plans, so it was just a sadistic gamble of a witchhunt. don't ever quote that crayphole event as if it's anything worthy of reference.

@@unclebounce1495 Yeah, the whole "trial" was a farce in general. Not just for the "follow orders are not a defense" reason. I mean most charges were based on "laws" which were created after the fact. Did a lot of these people deserve punishment? Hell, yes. Was it based on any law at this time? No. It was vengeance. Maybe justified, but still just vengeance.

When I was stationed in Cherry Point Marine Air Station I had a friend who was a corporal and his dad was one of the MP's in the court room in this movie. They used actual Marines for a lot of the shots. His dad still talks about it to this day. Great movie

i always tear up at the end when they were dishonorably discharged, the two actors portraying those Marines were just as phenomenal as the rest of the cast!! :)

They knew they harmed Santiago resulting in his death. It was manslaughter. They were LUCKY to only get the DD.

The acting was great, I really got invested in the story. Jack Nicholson really shows why he is so highly regarded at his craft.

Nicholson is an absolute legend by this point in his career, ranking among the greatest film icons. The fact that he’s not even in this film a lot (and still steals the show) says something about his power on screen.

When I was in the military, one of the first things I was told was that if I was ever given an illegal order it was not just my right to refuse the order, it was my responsibility. This goes back to the Nuremberg trials where high ranking Nazis said they were just following orders. For generations, this has not been an acceptable excuse.

The caveat being that if they didn't know it was unlawful or someone couldn't reasonably think it was unlawful (such as marines at guantanamo Bay who regularly carry out, receive or witness "code reds) then it can be a defense

I earned my Criminal Justice degree in college thanks to my time in the military. The Uniform Code of Military Justice is designed to protect our uniformed soldiers and when foul play or an unlawful order is discovered, to deliver the maximum punishment and penalty against those that violated one's basic rights. This movie is complete and utter satisfaction while still being an epic thriller to me. ❤

"I was only following orders" is the defense Nazis used - entirely unsuccessfully. As a veteran of the U.S. Army military police, I can assure you that you are REQUIRED to refuse to follow an unlawful order - such as beating a fellow service member as some form of "discipline." The characters absolutely deserved to be convicted of conduct unbecoming and to be dishonorably discharged.

@@Etereys while agree with you both, reality is a bit different. When I went through basic back in the early we had a 4 of Private Pyle's in our platoon that led to the platoon getting hammered by our DI on a daily basis. There were a few "soapings" and as a squad leader I stepped in which just ended up getting me soaped. 3 of those 4 shaped up and became great squad mates, the 4th washed out on medical (which was for the best). Was the soapings right? Hell no. Would I go to my DI and report it? Hell no.

Yeah it's true in theory and I was thankfully never put in the position but I'm sure it's a lot harder to turn it down.

@@blainehancock it's also peer pressure and, to a degree, fear. If all of your squad are psyched to do it and you say no, then you're not part of the squad anymore. You lose that trust and camaraderie. You also stand a good chance of getting hammered. Is it right? No Is it moral? No Is it human? Yes

Jack's rank was colonel, Markinson was a Lt colonel, Kendrick was a lieutenant, Jo was a Lt commander (equivalent to major in the other four branches), Caffey was a Lt junior grade (equivalent to a lieutenant in the other four branches), and Ross was a captain (equivalent to a lieutenant in the Navy).

Actors on the set said that Nicholson loved playing this role and did take after take of his speech on the stand. Usually actors just get their part filmed and aren’t there when the other actor does their take, but Jack did his part over and over while they filmed Tom Cruise’s lines.

The true villain of this movie got off scott free: the doctor. Col Jessop never heard of Santiago, proving he bore him no ill will. He simply thought he was lazy and/or unfit. The doctor is to blame since he failed to diagnose his heart condition.

They are both guilty in different ways. The doctor misdiagnosed Santiago due to his negligence and incompetence as a medical professional. Jessup’s fault is deliberately disregarding an order not to execute Code Reds. That’s worse in intent than the doctor’s incompetence. If the doctor were prosecuted and convicted he would probably face less severe punishment than the colonel.

Man, I am SO GLAD you did this one! 👏👏👏 And the guy who played Harold Dawson, Wolfgang Bodison, wasn’t even an actor when they cast him for this. He wanted to be a screen writer or director but Reiner couldn’t find anyone he liked for the part and Bodison was around working as a location manager so he asked him if he’d ever acted. That was it - he got the part. Crazy.

One of my favorite movies of all time and one of Jack Nicholson' finest performances. He did that courtroom speech all in one take, during multiple takes because the director wanted to try it with different camera angles and positions.

It made $243 million dollars at the box office against a $40 million dollar budget. Nominated for 4 Oscars including Best Picture and 5 Golden Globes including Best Picture but didn't win any.

Have seen this movie well over 100 times, and I never get tired of it. It's an absolute tour de force in all departments. It was made over 30 years ago and still looks absolutely stunning, too.

If you are wondering what Demi Moore's saying "I am sorry I lost your set of steak knives" was referring to. In the beginning Sam said Kafee successfully plea bargained 44 cases. Kafee jokingly said one more successful plea bargain he would win a set of steak knives.

Nathan Jessup was a full bird colonel. Markinson was a lieutenant colonel. Kendrick was a lieutenant. Dawson was a lance corporal and Downey was just a private

That is a awesome movie! Another good movie is rules of engagement by Samuel L Jackson. And the entire TV series of Jag. That was my favorite TV show when I was younger.

I spent 23 years in the U.S. Navy and one thing I do know is this. If given an Order that is unconstitutional it is your duty to disobey having said that it can also have consequences within your unit or Commanding officer. Ok, I have been recommending a few movies every video and you loved everyone I recommended like “Law abiding Citizen” Trust me Devin! I will not disappoint you! THE LAST CASTLE with Robert Redford is a must watch, I will now make a few other recommendations that you may enjoy, 1.) The Last Castle (Robert Redford) this movie is awesome and only has 2 reactions from terrible movie reactions (⭐️⭐️⭐️⭐️⭐️) 2.) Frailty (Mathew Mcconaughy) Supernatural edge of your seat thriller 3.) The Devils Advocate (Keanu Reeves) Supernatural 4.)The Replacement’s (Keanu Reeves) Feel Good Light Comedy 5.) Hardball (Keanu Reeves) Feel Good movie 6.) A time to Kill (Mathew Mcconaughy and Samual Jackson) ⭐️⭐️⭐️⭐️⭐️ 7.) Boondocks Saints this is a cool movie with a cult following but it is very cool! 8.) Men of Honor (Cuba Gooding Jr. and Robert Dinero) True story of Carl Braushers who was the first Black Naval Master Sergeant who was also a master diver. I haven’t let you down yet, every recommendation I gave in the past that you watched got no lower than a 9 Trust me DevinG!

My friend Alton lost his dentured tooth when a wave hit him while swimming in the Gulf of Mexico the very first day of a week long vacation. We made fun of him all week because he had a gap in his front teeth. One of the things I said to him was..............."What did Alton say to the Ocean?" He said, "I want the tooth" and the Ocean replied "YOU CANT HANDLE THE TOOTH!" I got a lot of laughs with that one! Fun week making fun of my toothless friend!

As a ex-marine when i left okinawa it took a long process to leave the island/ get transferred off base. So jack Nicholson had a hole there in his story. Great movie. Great reaction.

After high school I had a friend that went to Cinema School at the University of Southern California. He got to watch movies before they even came out in the theater. He even had the opportunity to copy them on VHS and send them to me. I got to see this movie, Reservoir Dogs, Glengarry Glen Ross, and A River Runs Through It, all before they hit theaters. Still some of my favorite movies.

They just don't make movies like this any more. Every actor in this film literally gave their greatest performance - especially Tom Cruise and Jack Nicklinson. I knew you would appreciate this film. Thanks for sharing.

Jack Nicolson wasn’t even in the movie for very long, but he straight up OWNED that movie. Tom Cruise was awesome, but Jack is the man! LOL!

They followed the order to code red the guy but they never thought for themselves if it was a lawful order. It's still up to the person getting the order to decide if it's lawful or not and act accordingly.

31:54 And I will always love that moment when Kaffee goes into a brief state of stunned silence. The fact that he got what he was fighting for and that Jessup openly admitted it in court... It's one of the best scenes and finest moments of acting ever. My family still get chills from it everytime we watch this movie no matter how many times we see it and even though we already know the ending.

Not the oatmeal pie!!😊 loved your reaction to this film. Tom Cruise is my favorite actor and he always give A+ performances. You should react for the Firm, another Tom Cruise classic performance. Also, Rain man with him and Dustin Hoffman is a beautiful story.

My ex worked for the Dept of Defense in Florida. He designed dive systems for different branches of the military. He was at Quantico Marine base in Virginia with his co-workers and some marines one evening. Those "so-called" marines took my ex's co-worker who was slim, wore glasses and was quiet, they trussed him up and drug him up to the ceiling. They then let him drop to the floor. I was so f#%king pissed when I found out. If I remember correctly, someone told and, they were being investigated. This was back in the 90's.

Kiefer Sutherland plays the intimidating/menacing character so well. Still, I’ve always had a huge crush on him. Something I really loved him in that always seemed to be under the radar, was Flatliners.

I was a paralegal in the military, and I promise you that the articles that charge Service Members with disobeying an order specify that it must be a "lawful order," and this type of thing is not. In real life, they have a duty and expectation to disobey illegal orders, so that is why they were found guilty on that. It is also against the UCMJ to assault people, which is what would make this an illegal order. This is a great movie, for sure...thanks for doing it.

Thank you for your video. I was a contractor/painter when I was about 24? A lot of the men I worked for were WWII vets. I grew up in the military. These men would tell me their secrets sometimes. Some of it was awful. Some was heroic. Korea, Vietnam as well. I always thought I'd serve but I never did. 4F.

One thing that really burns my hide is people saying about this "They didn't do anything wrong! They were just following orders!" That just don't fly. I don't know how the marines do things, but when I went through Army basic training, we got whole blocks of instruction on things like this, on "lawful" versus "unlawful" orders. One film they showed us (yeah, it was film, as in a film projector) showed a situation where a soldier had taken three prisoners. The radioman reported that to the CO and the CO replied "Okay, when I report this I want to give a body count of three." (In other words, kill the prisoners). The radioman says to the first guy "He wants a body count of three", and the first guy shoots the prisoners. The film went on to point out that everybody there was guilty of a crime. The CO was guilty of issuing an unlawful order, the guy who shot the prisoners was guilty of carrying out an unlawful order, and even the guy on the radio was guilty of passing on an unlawful order. They made it clear that "just following orders" is NEVER an excuse for breaking the law. And as for this "unit, corps, God, country" bullshit, show me where THAT is in the regulations. It ain't there. So yeah, the sentence of the court at the end was totally justified, although I'd say, in this fictional scenario, they really need to re-examine how the marines at Guantanamo Bay are trained. They need to reinforce that they serve a nation governed by Law, not some grotesque military cult. For the record, I realize that's not how it really was when this was made, and I assume that's not how it is now... but I worry.

Since you enjoyed A Few Good Men, a couple other military courtroom dramas I think you’ll like are “The Caine Mutiny” and “Rules of Engagement”. And a military crime thriller I also think you’ll like, “The General’s Daughter”

Dawson was punished for feeding a different marine, a private Bell if I'm remembering correctly. I agree with you that based on having already been punished for disobeying an unlawful order, by sneaking food to Bell, Dawson at the very least should not have been discharged, let alone a dishonorable one at that. Downey on the other hand, while I personally don't think he should have been punished, it's a bit trickier as he doesn't have an excuse beyond following orders. You also have to remember that even in the Military, Marines tend to be a different breed and even more so in combat units. It's the officers that should have received all the punishment, and the men further trained on lawful and unlawful orders. The other thing to keep in mind is the military has changed and evolved quite a bit since this film was made, let alone when the screenplay was written.

7:57 That guy's name is J.T. Walsh who's since passed away but he's been in a couple films starring Kurt Russell I'd recommend. One is called 'Executive Decision' that came out in '96 and the other is called 'Breakdown' that came out a year later in '97. Kurt Russell was fantastic in them both. Two really good thrillers IMO.

One of my favorite films of all time and the most perfectly cast. The talent of the actors and director shine in every scene. I re-watched certain scenes just for the sheer magnitude of the drama. When private Downey is on the stand and turns to Dawson crying "Hal? Hal!" I forget that they are actors and this is actually just a movie.

One of my favorite movies of all time. Can quote the entire thing. The cast is STELLAR!!! Phenomenal performances and an amazing story to give civilians a little look inside the culture. Thanks for doing this. I've always wondered what a Vet would think of this film. Yesterday's military is a bit different today - thank God! As I understand it, they are not required to follow an illegal/immoral order. Otherwise, you have the excuse the Nazis used - 'I was just following orders'.

I’d recommend you see (Casualties of War). It’s a really gritty movie starring Michael J Fox that takes place during Vietnam.

From what I've heard there actually ARE orders that a soldier, in good conscience, can absolutely not follow. The risk and consequence for disobeying orders is high, but that's the whole reason for a judicial system to determine if the unfollowed order was in the best interest of that soldier's safety, his units, safety, or the public's safety. Kinda makes me wonder if there's ever been a soldier who willfully disobeyed orders, but never was disciplined for the disobedience because his actions (or lack thereof) actualy saved more lives than it endangered. I'm probably sure there's a few interesting stories out there! Great reaction, Devin!

If a service member refuses an unlawful order, he should request mast, or whatever the equivalent is in the army and Air Force. And if they want to NJP him, he should refuse it and request a courts martial. Almost guaranteed higher authority will throw it out because once they start digging into the matter then their gun sights will be on who gave the order not who refused it. And the command that Marine is under doesn’t want those problems.

Devin, you keep saying they had no choice but to follow orders, and that they did nothing wrong, but that's not true. Article 90 of the Uniform Code of Military Justice specifically says soldiers can only be punished for willfully disobeying "lawful commands" from their superior officers... but a "code red" order to beat and torture a fellow soldier would not be a lawful command, so their duty in that case is actually to disobey. This is backed up by military case law too, look up "United States v. Keenan", where the Court of Military Appeals stated "the justification for acts done pursuant to orders does not exist if the order was of such a nature that a man of ordinary sense and understanding would know it to be illegal."

I saw this movie in the theaters not having a clue what it was based off of. At the time had no idea it was a play. Blew me away. The intensity of the court room was strong and the cast was loaded and very good. Jack as usual was amazing. Remember the Titans! is my suggestion for a good movie. Damn hope it is not one of those copyright nightmare movies.

This movie is a classic. All the performances are perfect, the pacing is fast and Rob Reiner does a great job of making the legalese accessible and interesting.

oh DUDE I just realized that when he says "you don't need to wear a patch on your arm to have honor" it's exactly the same message as in The Wizard of Oz when the scarecrow and the tin woodsman and the lion receive a diploma, a testimonial, (the heard-shaped clock,) and a medal, EXACTLY! (Because they already HAVE a brain, a heart, and the the nerve.) SUBSTANCE. THAT'S what matters, not image or appearance or presentation.

I remain critical that Wolfgang Bodison ("Dawson" - "Yes, we did something wrong - we're supposed to fight for those that can't..." - in this, his first ever film) WINS at ever level in his performance but apparently no one's offered him big roles that such a performance deserves. Is he a jerk or something? I have always wanted to know.

Marines are just a different breed of soldier. My brother is retired but says he will always be a Marine first and knowing him and he friends they just carry themselves differently. Just speaking from my own experiences.

This movie is awesome and I love your reactions. “YOU CANT HANDLE THE TRUTH!” One of the most iconic movie lines in history. I know you don’t usually do the calmer movies (that I’ve seen) but maybe you could consider reacting to “The Help”. My favorite line from that movie? “EAT MY SHIT”. It was awesome.

Great react. even though I'm not the biggest fan of this movie because Tom Cruise chracter is too arrogant and I found it a bit annoying because I thought the woman character deserved more credit for her work, but it does have some good bits, especially the courtroom scene. Movie suggestions: *Clear and Present Danger (1994)* (incredible movie) *Hancock (2008)* *Kick Ass (2010)*

The scene early on when Jessup jokingly tells his aide to "get the president on the line, we're surrendering our position in Cuba" is in place to show the viewer that Marines follow orders without question. No matter how major, minor, serious or silly -- if given an order, reply with a "yes, Sir" and get right on it.

For those who don't know, a dishonorable discharge alone is pretty severe punishment. Say goodbye to any VA benefits, federal loans, and any possibility of federal employment. You can't own firearms. No student loans, no VA mortgage assistance, no GI Bill for college. Plus, that will show up on every background check any employer ever runs on you, which will make it harder to get a job.
