It’s hard to say for sure, but I think it depends on what type of video you’re making. In the past, Nintendo has taken down videos that include ONLY their music - my videos, for example, may very well get taken down at some point. But my guess is, if you’re making a video that contains your own visuals/audio and just have the Nintendo music in the background, it’s probably ok. This is something many people do without repercussions. I can’t give any guarantees though
