It is up to the judge. However out of 300+ cases this DA has recommended for resentencing, the judge deciding has only denied 6. He denied those 6 because the victims family were strongly against it. In this case, the victims family is literally begging for them to come home.

The night stalker scraped his knee when he was a little boy. He should have been released early because of that trauma he suffered. Next thing you know we are going to let out other killers because of the trauma from going to the dentist. Everyone endures trauma as we grow up. Most of us don't use it as an excuse to kill people. A scraped knee is miles away from horrific abuse from the two people that they should have been able to trust. Its not an excuse but it is a reason. They are not saying they didn't do it, they are stating that their are circumstances around it. The DA that tried them literally said that "men can't be raped because they don't have the right equipment". The father also threatened to kill them if they spoke out. There is also someone besides them that has come forward and spoke out that he was raped by Jose. He was in the band that Jose managed.

Your example is terrible, and here's why: The night stalker was a psychopath sadist - which means that his neurobiology renders him STRUCTURALLY INEQUIVOCALLY unable to ever be sincere, learn from mistakes or accurately appraise the consequences of his actions, much less repent or try to atone for the horrendousness of his behaviour. He NEVER HAD consciousness or empathy, was born defective in the worst way that a human can come into the world. The Menendez brothers are two people who have undoubtedly commited a very serious crime, and while their act is ethically condemnable, it's also humanely understandable, given their circumstances. And while it IS true that at first they tried to hide it - which does shows dishonesty - it is also true that they were freaking out about it the entire time, having bad dreams, experiencing remorse.
