It is up to the judge. However out of 300+ cases this DA has recommended for resentencing, the judge deciding has only denied 6. He denied those 6 because the victims family were strongly against it. In this case, the victims family is literally begging for them to come home.

The night stalker scraped his knee when he was a little boy. He should have been released early because of that trauma he suffered. Next thing you know we are going to let out other killers because of the trauma from going to the dentist. Everyone endures trauma as we grow up. Most of us don't use it as an excuse to kill people. They are not saying they didn't do it, they are stating that their are circumstances around it. There is also someone besides them that has come forward and spoke out that he was raped by Jose. He was in the band that Jose managed.
