One wonders if “someone” is “feeling out” public reactions to yet unreleased opinions. Wasn’t Chief Justice Roberts supposed to do an internal investigation and crack down on these all-too-frequent security breaches? You are all wrong from the get-go! The federal government was not given any power by the founding fathers in the Constitution to regulate health care. The FDA uses an Interstate Commerce Clause which now includes all commerce in the United states in order to control the SALE of medicine but NOT health care delivery OR THE REGULATION MEDICINE. The various states also must protect the consuming public and cannot deny access to necessary, reasonable, and appropriate health care delivery. Since the federal government was not given any power in the regulation of healthcare why is this Supreme Court considering issues concerning the regulation of healthcare when it's not under their jurisdiction? The real question before the Supreme Court should be why would the states conspire to deny health care delivery that is necessary, appropriate, and reasonable? The state and federal governments can promote the general welfare by providing for healthcare funding but they cannot deny necessary, reasonable, and appropriate health care at all. They simply don't have that Constitutional power to regulate health care or medicine on a federal level. On a state level, the medical boards consisting of licensed providers are the ones that make regulatory decisions to protect the consuming public. From a purely rational medical perspective, if you don't save the life of the mother, you most likely will not save the life of the fetus. It may be possible in a late-term pregnancy that the baby could be delivered by C-section while the mother is left to die. That unique situation would have to be dealt with in its own unique decision-making process.
