With Congress on break, Escudero explains what's next for VP Sara impeachment process | ABS-CBN News

Senate President Francis "Chiz" Escudero said Thursday (February 6) that "legally, an impeachment trial cannot be done" on Vice President Sara Duterte during the Congress session break.
More than 200 members of the House of Representatives on Wednesday signed an impeachment complaint against Duterte, paving the way for a Senate trial that could see her removed from office. But the Senate adjourned its plenary session on February 5 without tackling the articles of impeachment.
Escudero said the Senate secretariat would have to verify the signatures on the impeachment complaint and revise the rules. The revised rules will then have to be approved by the Senate, he said. He added that the earliest Senate action on the impeachment could come on June 2.

Very wrong si Sen Chiz on the issue of carry over. It is not. If an impeachment case was filed in the 19th Congress (2022-2025) and the Senate failed to finish the trial before the 20th Congress (2025-2028) begins, the case does not carry over. The complainants must refile the impeachment case in the House of Representatives, and it must go through the entire process again.

A delay until 2 June 2025 (several months later) would likely be considered **unreasonable** and potentially unconstitutional unless there are compelling justifications for the postponement. The Senate should prioritize the impeachment trial and, if necessary, reconvene earlier to fulfill its constitutional duty. Forthwith means immediately or as soon as possible. It does not mean however that it should be made the following day. It merely means that it should be tackled within a reasonable time. Having said that, the senate should do the administrative preliminary processes because if the senate is not in session, it does not mean that its adminstrative personnel ceases to function until the next session's opening. Finally, if indeed escudero wanted to tackle the impeachment case in this current congress, all he has to do is request the president to call for a special session of congress. We, the people, don't know what's going on anymore in our country. It seems that personal political interests yet prevail over the people's desires.
