Can a pending asylum seeker who entered unlawfully, apply for emergency parole ?

Hello, Asylum applicants may be able to request parole, and even emergency parole. However, if your case is pending before the immigration court, then departing the USA can result in a finding that you “self-deported.” Please confirm with your attorney to ensure that departing on parole will not jeopardize your case!

Thank you! Do you know how Biden's new Parole in Place works with people who are subject to the 10 year bar? I can't find any information about it.

Hi, Stacey, We are still waiting for the final regulations on this new program, so we’re not sure yet exactly what it will involve, but if it functions like military PIP, then it should effectively “waive” the 10-year bar to allow the applicant to apply for an receive adjustment of status. However, if it functions like the other PIP program, it won’t waive the permanent bar, so people who have multiple unlawful entries after more than one year of unlawful presence in the USA may not qualify. We’ll have to see. The organization called American Families United is working very hard to influence the administration to broaden the program to include more spouses of U.S. citizens.
