My husband is in an extramarital affair with his ex grlfriend from last two years, and they both knw vry well that law is in their favour nd nw adultery is not punishable, so giving me immense torture nd our kid nd myself are suffering in this. If adultery is legal. Then the government should make marriage illegal ....isn't it . There is no meaning in marriage if adultery is not an offence . It should be included in marrital agreement whether husband wife agree to have external marrital affair and individual person should be given this choice in agreement they sign. That agreement can be held responsible in divorce. All exit doors must be looked at or locked down before entering into any agreement. Just like in job we have to sign "at will" work , there has to be provision 8n marriage agreement for at will affair. If wife doesn't want to allow that permission for husband then she is automatically not allowed to have at will in her marriage but if husband allows them he can have that will. In such cases wife can choose to go ahead and marry such person and accept him as her husband or not. Laws should not be gender biased. Laws are laws applicable for both the parties. Most of the Indian laws I don't agree with but that's my personal choice and opinion. Laws should be equally applicable to all, make it simple not complex. As such marriage institution is broken, when live in relationship was given legal status, there is no need for marriage. Just live in relationship for a while and then separate when you had your needs met. By allowing live in relationship legal, they have given new name to "one night stand" or "prostitution" and made it legal for everyone. Law in India is broken.

So first the individuals must go into a non consenting marriage or and marriage with no understanding of other person involved. In India dating is frowned upon . Then go to a marriage without emotional connection and /or rape ( which might mean no legal recourse). Yet if individuals find some form of solace in a different relationship the individuals must face jail time or fine which cannot be called justice.
