First of all ,if it's committed with out the consent of wife ,it can't be termed as adultery rather it would be a rape ..well if wife is in comma and she happens to be sexually assaulted in front of her husband so court can take cognizance of her husband's statement and can charge M under section 376 ..where as victim her self is not aware of the situation and no one literally witnessed it ,in that case ,nothing can be done unless there is strong circumstantial evidence which can corroborate the charges made against M..thanks for such explanation. .

This law seems to be in favor of women. If wife and M agreed to be in a physical relationship and if wife is not considered as guilty then even M should not be considered as guilty. However, husband can lodge a case against both of them and use it for the grounds of divorce. In such divorce cases wife should not get any compensation from husband's salary or income. Above all, we live in a free country and having an affair outside marriage should not be considered as a crime by any party or law, but can be used for the grounds of separation and divorce

I think this defies the fundamental of equality in our constitution. Both the people involved in the unlawful and conscious relationship should be considered guilty. Secondly, there should also be a provision made for the wife to press adultery charges against her husband if he maintains sexual relations with a second woman. Thirdly, the foundation for this law that the wife is the "property" of the husband seems incorrect. Humans can't and should not be considered property.

In the last case it was mentioned that whenever there is not a consent of both husband and wife.... So simply it implies to all the rape cases vistimised some married women..and if the victim is not in a position to give statement then it is sure that there should and must be a special investigation of the whole case covering all the past incidents ... With this law indian judicial system has proved how wastefully complicated they can be in framing such a conditional and confidential matter into crime against any innocent man ... It remindes of the case with rustom pavri.... At last it is to duty of our nation to form simplified and open ended constitution to get true judgement leaving away all the self made assumtions...

I am amazed by this law. Firstly if a women or a man being in a relationship as a couple, and it is proved that one of them is doing adultery, then there should no discrimination, both of them is guilty and should be punished. Either wife or husband.

A woman in coma still has her fundamental rights intact (I guess even a dead body has some kind of fundamental rights as you can not take their organs with his/her own or family consent). So if there are enough evidences available and a case is file by someone on her behalf, the culprit can be prosecuted.

Congratulation Sneha, this was the best comprehension I have seen on the judgment, not even the RSTV gave such clarity. I hope you are a Law Student and even if not, you have a sound jurisprudence. One thing if you can tell me or make another researched video, can you give differentiate comprehensive between Civil Laws and Criminal Laws. I am searching for the difference from the very angle of Jurisprudence. I am asking for this favor because, be it Section 377 or 497, there is one thing that has been struck down, that is the criminality while most of us do not even know what Criminality is?

Last case comes under sec. 497(adultery). women was not in a condition to tell her situation as she is in coma..and acc. To court husband becomes her natural guardian then he can file a case under sec. 497. Its my opinion..
