It almost certainly stems from actions he took after the escape. I do not believe this was planned in any way, otherwise his "accomplices" would have been waiting outside with the car. He saw an opportunity and took it.

@@chad_b That wouldn't be assisting with the escape then, it would be harboring a fugitive. By legal standards, the escape was complete once he stepped out of the building. If he had been caught before he stepped outside, it would be attempted escape. But, if he was out on bail or bond, then technically it wouldn't be escape at all unless his bail or bond had been revoked already. You can't escape if you aren't already in custody because you have nothing to escape from. The reason I mention that is because he had just been convicted of the first charge and was waiting on the jury to return with the second charge. I feel like there's something more to this than what they told us.

You are correct for sure- insane. This is an extremely unfair sentence no matter if he is a career criminal or not. This is really a shame. I've seen a recent case of a person involved in human trafficking who committed a very high number of brutal assaults against women, keeping them in trafficking, and he in effect forced each of them to be raped thousands of times, and he got 11 years- even though it is clear that if he was sentenced for all the crimes he committed the sentence would be thousands of years. The sentencing in our criminal justice system is so inconsistent and is so often unjust. The six years for one day of freedom was also way too high- six months would be plenty enough in my opinion.

The guy didn't escape. I did my own research and found he had been out on bond. He had just been convicted of one count on his indictment, but his bond had not yet been revoked. His bond was still valid, and he committed no crime by walking out. You can't escape if you aren't currently in custody. That's why they didn't charge him with anything. Because they couldn't. All they could legally do is revoke his bond, and send the police to pick him up. How his brother got 6 years for aiding an escape, when there was no escape is unclear. That shouldn't have happened. It's like how you can't be convicted of resisting arrest unless there's a valid underlying offense you were being arrested for when you resisted. My guess is he had a public pretender and they conned him into taking a pre-indictment plea.

Fun Fact: In germany breaking out of prison is not against the law. It of course is against prison regulations so anybody breaking out of prison can get a disciplinary punishment (like for example revocation of certain priviliges) from the prison, but he will not get a criminal charge for that. Of cousre if he commits a crime in breaking out of prison or while outside the prison he can get charged for that, but the escape itself is not a crime.
