Hello..sir I wanted to thank you for the revision lectures of LLB first semester. Because of you I was able to score 60 plus % in first semester. Even though I have prepared the subjects for like 2 to 4 hours..still I got great marks because of your passion se bhare lectures. My highest marks was 70 in law of torts

Can a writ of habeas corpus be issued in case of kidnapping?

@@LawsWithTwins if yes, than to whom the court will direct to produce the body in case of kidnapping? For example, let's suppose my son is kidnapped, and I move to HC for writ of Habeas Corpus, then to whom will the court give direction to produce the body?

@@vivekranjan7442 court has inherent power to order to police . These things are not written anywhere and it's questions of laws can be decided by Hon'ble supreme court only . We can just give our reasoning of no case is there already decided. That's why , court can direct police authorities to produce kidnapped body before then

@@LawsWithTwins But the case here is not of illegal detention. Body is not with the police authorities. Here, the case is of kidnapping, and you coming back to the same point that court will order police to lodge an FIR for kidnapping and then investigate the matter under sec 363 IPC and find out the kidnapped person. Then what is the use of writ of Habeas Corpus?

@@vivekranjan7442 sir this question is decided by guahati high court ... Gau HC | “Illegal detention or kidnapping is a pre-requisite for invoking writ of habeas corpus”; HC holds habeas corpus doesn’t apply on missing cases Yes it can't be issued .
