Here's our suggested response you can copy and paste to the ruling comment to have it withdrawn: The undersigned oppose the Consumer Product Safety Commission’s proposed Direct Final Rule in Docket No. CPSC-2023-0021. As written, the effect of the Commission’s proposed rule would have significant and unnecessary economic impact on the undersigned and all in the air-soft industry. The Regulatory Flexibility Act (AFA), 5 U.S.C. 601-612 does apply and requires the Commission to prepare an analysis under 5 U.S.C. 603, 604. Without comment from the industry, the proposed Direct Final Rule would be inappropriate and unacceptable without changes. The Commission’s stated basis for the Direct Final Rule Process is that the new 16 CFR Part 1272 contains no substantive changes from regulations in effect now for more than 30 years. The reason for the new 16 CFR Part 1272 is that recent federal legislation has transferred oversight and enforcement of the regulation from the Department of Commerce to the Commission. Because the Consumer Product Safety Act requires certain certifications for products subject to regulations enforced by the Commission (see Supplementary Information, Paragraph G in the docket entry), the new, proposed 16 CFR Part 1272 would unnecessarily impact the air-soft industry negatively, substantively and financially. The subject regulation was enabled by 15 U.S.C. § 5001 which imposes certain marking requirements on “look-alike firearms.” Look-alike firearms include “air-soft guns firing nonmetallic projectiles.” 15 U.S.C. § 5001 (c). While the undersigned have long complied with this statute and 16 CRR Part 1272, there has been no requirement for any general product certifications (GCC). Now, apparently, there would be such a requirement. See Supplementary Information, Paragraph G in the docket entry. Because the Commission states in the subject docket entry that the Commission would be requiring GCCs for air-soft guns, the undersigned and the industry request an opportunity to comment under the Administrative Procedure Act (APA). See generally, 5 U.S.C. 551-559. The undersigned and the industry request that opportunity to address whether GCCs for air-soft guns under 16 CFR Part 1272 is necessary. It is readily apparent upon visual examination whether an air-soft gun complies with 16 CRR Part 1272 marking requirements. GCCs are not necessary. The undersigned believe the Commission is also required to conduct a flexibility analysis under 5 U.S.C. 603, 504. Many in the industry are small businesses. The undersigned also state that they and others in the industry are not equipped to provide GCCs for their air-soft products, in the near future, particularly those that would comply with the legal requirements. See, e.g., 15 U.S.C. 2063 (g). Many of their air-soft products are in transit, in inventory, with distributors, and in retail stores. Accordingly, the undersigned requests the Commission withdraw the proposed direct final rule. The undersigned appreciate and understand the Commission’s approach and requests the Commission consider excepting air-soft guns from any requirement for GCCs. Thank you for your consideration.

I totally understand why this is something being considered in the past some models of airsoft guns have had real firing pins in them and could be modified to shoot real bullets. Essentially it's a really easy way to create a ghost gun. Even easier than 3d printing. However those guns are extremely rare and I don't know if any are even currently on the market. This could also potentially increase the quality of items we receive in the states. If each individual gun and part has to be certified then the likelihood of getting a prototype that doesn't actually work pretty much goes to 0. But also like he said it has just as much potential to completely disrupt the industry and put smaller retailers and manufacturers out of business.

This is the way it is done here in Germany for more than 20 years. The testing costs 400€ for the importing company. This is the reason why many Umarex guns have an F in a pentagon on the frame, even in the USA.

Well this just means they want to find ways to limit how much airsoft people have access too, and it goes a step further and will one day find a way to go after firearms in a similar fashion. It will effect the airsoft guns you already own as well. For example, if law enforcement sees you with an airsoft gun they can ask for your ‘certification’. If you can’t provide one then they can confiscate your ‘illegal’ replica.

Thanks for laying out in detail - something that a lot of people are not doing and there is a considerable amount of misinformation right now. That being said, there is no requirement for third party testing. A visual inspection of airsoft guns to ensure an orange tip is present meets the burden of proof for a GCC. This is actually commonplace where a visual inspection to ensure a label is attached for example meets the requirement. The other thing is that the certificates don't have to be enclosed with every single gun. The importer can make them available on a website and as long as they are readily accessible to CPSC, this meets the requirement. It also doesn't apply to end consumers - there is no requirement for consumers to have proof of certification. It only applies to manufacturers/importers.

Everyone should keep in mind that airsoft is a business industry, and there are lawyers and successful businessman always doing what needs to be done to make sure they can conduct business. Support your retailers the best you can during this time, if this new legislation passes, by purchasing basic stuff that wouldn’t be frozen by the new legislation like BBs, batteries, green, gas, etc.

It only affects buying airsoft guns. This does not affect people who own airsoft guns or play the sport. What this does is make sure that the airsoft gun's manufacturers have met the requirements to distribute said airsoft guns

The certification-law is already practiced in germany, and it makes everything more expensive and complicated. It is just anti consumerism and not a useful law. It shouldn´t exist. And I think, to a point, it may not even be constitutional, because it is an unnecassary law, that hurts the consumer, and has no advantages.

It's kind of a strange situation. This is actually a rule that's been in place in some form since the 1980s, and then brought back in the early 2000s. What's happened is they passed an energy act last year at the end of 2022 that Biden signed the law, part of that act moved the responsibility for all these things from the department of commerce to the consumer product safety commission. And best guess is that the cpsc is just reviewing all of these rules that they have to now oversee and are doing these rule changes. It's the same way that the ATF does rule changes for what is considered a bump fire stock or an arm brace. Because it's a rule change, of an existing rule that's there already, they only have to publish it and give it 30 days for anyone to see and voice opposition.

This situation is really unfortunate, airsoft is a sport like so many others. The solution is not to make modifications in the new production of airsoft guns. there are more relevant issues that would provide a more coherent solution to the issue of crime. I hope reason is used and they do not ruin this beautiful sport.

That is so wrong what matters if we play with fake firearms, are going to stop .177 pellet guns or normal copper bb guns from being sold or regulated think that through a plastic bb vs metal bb's what's the worst damage

I am the Consumer Ombudsman at the U.S. CPSC. Allow me to clarify some misconceptions about this direct final rule. This rule contains no new regulations. Zero. All it does is change the jurisdiction from Commerce to CPSC. It is just a change of agency. The manufacturers of airsoft guns are already following all of these regulations and have been for years. Nothing in this action requires third-party certification. CPSC officers are empowered to ask for a general certificate of conformity (GCC) but they almost never ask for one. If they ask for one, the manufacturer self-certifies, so all they have to do is affirm that they meet the standard. This will not affect anything being shipped right now. The simplicity of this change is the reason that it is fast. If we were to be making something new, it would have to go through all of the public notice and comment periods required by the Administrative Procedures Act - a very lengthy process. Finally, none of this regulation affects airsoft games. It just applies to manufacturers. I'm happy to answer any questions!

We just went through this **** here in Canada and we won, sorta. My advice to you guys is fight, legally, with everything you got and don't stop. Plus you can use us as an excuse if Canadians can get over this so can the American government.

Yes. Went into effect months ago. Didn't notice an effect? Neither did literally anybody else. Because it wasn't actually a real change.
