We fly over to the US often and the amount that happily drink while on the flight then pick up their hire car upon landing amazes me.. The “well I’m on holiday now” mode kicked in once boarded.. Getting in and driving to wherever they’re going with not a care in the world. Then driving on unfamiliar roads on the opposite side.. Surely they can wait a few more hours rather than take such stupid risks?

In Sydney we have random breath tests set up all the time. The police will set up on a road and stop 10 cars at a time and test every driver. If you show that you have had a drink on the handheld device then you have to go back to the booze bus to be tested on an evidential machine. The handheld device will pick up any alcohol in your breath so while you might be under the limit, you will still have to go and take a full test. This could take up to 30 minutes, depending upon how many “customers” they have. From my point of view it means that its not even worth one small beer before driving.

Whilst I strongly support targeting drunk or drugged drivers, when did we start doing random breath tests in the UK? The law states before a roadside breath test can be requested there has to be some suspicion of a moving traffic offence or suspicion of someone having consumed alcohol i.e. breath smells of intoxicants etc. I wonder what would have occurred if one of the drivers had refused to provide a roadside breath test. Refusal without lawful justification for the initial request would not be unlawful.

Legislation was passed in 2016 to enable them to set up roadside checkpoints at places and at times where/when there's likely to be more instances of drink driving than normal. Surely you've heard of xmas/new year campaigns over the years? This is no different. Not sure if that's the whole of the UK or just England.

@ Funnily enough as a retired Road Traffic Officer I have heard of the Christmas Drink Drive campaign, however unless there has been a bit of artistic licence from Police Force to Police Force there is still a requirement to make the process lawful. If someone is under the influence of alcohol, odds are they will commit a moving traffic offence i.e. excessive speed, due care etc and then you are empowered to conduct a roadside breath test. The Police Force I worked for never conducted random roadside breath tests even at Christmas. We would go out hunting for drunk drivers and it generally didn’t take long to find one, I think my record was four during an eight hour shift. It was like shelling peas sometimes. 👍

If you refuse you get charged with refusing to supply. As you said, the police have the power to pull you over to check your documents are in order without suspicion of an offence being committed. The same with drug driving. Refusal to identify oneself is an offence against the RTA.

A uniformed cop can stop a car being driven on a road at any time. They may have had a reason for the stop ie car defect, accident, poor driving etc and can therefore require a breath specimen. If they stop you and there are none of the above caveats they can still ask for a breath test but as they don’t have a supportive reason then you are under no obligation to provide a sample and can refuse. HOWEVER if they smell or suspect alcohol that then does make the request a lawful one and failure to provide becomes an offence.

UK needs random breath testing like Australia where every day somewhere in the state hundreds of vehicles are randomly pulled into large lay bys with 10 police officers waiting to randomly test them. You are under NO legal obligation to provide them with a breath specimen unless they have a reason to believe you have been drinking. The police can stop you at any time and ask you to take a breath test (‘breathalyse’ you) if: they think you’ve been drinking you’ve committed a traffic offence you’ve been involved in a road traffic accident. Just because you've flown in is NOT sufficient evidence for them to think you might have been drinking.

The fact people are in holiday mode and flight attendants are asking every so often if you want a drink... pretty safe assumption that someone on a plane will 'fprget' they are driving and have a G&T or whatever, then jump in the car a few hours later. Add that altitude alters how people process alcohol and it's an even safer bet. There is clearly suspicion/ And if you haven't had a drink why refuse a test? Why are you even arguing against trying to make our roads, where 5 people die every day (on average in the UK) a safer place? What is wrong with you?

I didn't want a family member killed by a distracted driver (and feel more strongly about that than losing my TV). Why should we settle for anything that's clearly wrong? There should be a balanced approach to policing and targetted by the frequency of crimes and the seriousness... and bad driving (through drink, drugs, distraction or just lack of skill) is right up there. Rather than moaning on KZbin that Police should be doing x instead of y... write to your MP and say you want the Police resourced so they can do x AND y.

If they didn't carry out the occasional operation like this motorists would a) complain and b) know there is no way they will ever be caught drink driving. Even if they catch nobody it reinforces the deterent. It sends a message you can't assume you'll get away with it. And thats a cost worth bearing because on average 5 people die on UK roads every day. Even more are seriously injured. A serious RTC )of which there are several each day) costs the UK taxpayer around a quarter of a million pounds. 8-10 officers for a couple of hours is nowhere near that.
