I’m a beneficiary and it’s been four years since I heard from the trustee never received any inheritance any information about assets not one word about anything. He ignores my calls and texts. There is no probate court involved can’t afford an attorney and he also stolen personal property of mine when I was at work many thousands of dollars worth. Sent me a text saying if I go to the authority’s he will sell my property for a third of what it’s worth and I will not get any of my inheritance. What do you suggest I can do ? Keep in mind that I cannot afford an attorney and their is absolutely no legal aid that help in this situation.

I’m aware that when there is a trust that there is no probate. When there is a will and in my jurisdiction if the Estate is valued over $75,000 it goes to probate. My question is since there is a Will & Trust would that go to probate ? My jurisdiction is Minnesota

I'm a beneficiary of my dad's trust my estranged sister is the executor I talked to estate attorney but not my sister about the will my son is the trustee how do I find out about the will through court or wait on my sister to do probate which she lied and told my kids my dad left no inheritance which I searched out and found out he had a trust and a beneficiary

My kids also all of sudden have alot of money after my dad's funeral and my kids lied for my sister about my dad's estate and when I found out he did my sister called the estate attorney and wanted to know how I found out about the trust so can I found out of she gave my kids my part and is the will separate from an estate or does she have to add all his assets to the trust

i just turned 18… my sister is over all of my parents estate. she never told me about the probate court or anything. so a couple days ago i went and pulled records and found her attorney. what should i do now in order to recieve my inheritance because she is refusing to release it to me.

@@brownsdetailing What can you do ? She has an attorney and you don’t ? Back to your question regarding what can you do. If you don’t have an attorney then don’t be a fool and try and be your own. If you can’t afford to play the court systems game you will lose before court even begins.

My grandmother passed away November 19th, 2023. Around 8 years ago I went through a court house signed paperwork that I was getting 6 acres, 3 bedroom 1 bath house and to take over the taxes on the property. I have a little brother that will not leave the premises without a fight. What should I do? And to note he has others living there with him.

Can I sue my brother in small claims court for stealing my inheritance? Became power of attorney, over my mother. Got ahold of her bank account and emptied it. I can't afford to go civil I think. I just wanna make him pay and show him he can't do that to me.

It depends where you are located and the circumstances of the account. Usually, you have to sue through filing a Civil action in probate court (that's how it works in California). But every case is different. May be worth a try.

So it happened in Texas. In September 2020, the maximum amount you can get in small claims court will be $20,000 which would be about half of my inheritance. I already contacted a few lawyers, and they told me it could get really costly to go through this, and there's no guarantee that he doesn't spend it. That's why I was considering small claims court.

How do I make an attorney showing my inheritance $ and will not distribute . Nothing I have done ,texted, letters, calls , since 2013 has convinced him to give me my money. It's a small amount; but probate court says it is mine. He laughs at the state disciplinary board and the state bar . All other family members that were entitled are deceased. All I want is the amount that by a court decision is mine. He pays no attention to the judge who presided over this case. I have even had the local sheriff send a deputy to his office to have him contact me. No result whatever. Please tell me what I can do to receive what legally belongs to me. This attorney has done several other people in like manner. Thank you much .

The only options you have is to hire a new attorney, fire the POS you hired, but do it in writing so you have documentation. The other alternative would be to contact your attorney general in your jurisdiction

I’m a Co-Trustee and surviving spouse the Attorney/ Co- Trustee sold my life estate property without telling me my rights as surviving spouse and put his name on deed and mine.Then took 200,000 in fees without informing me that he was the one selling plus we didn’t discuss him getting that money 13:32

So I'm going through the same thing. Only mine is really old. But I found out alot! Now in California so long as there is no stay on the judgement I can collect and there are no limitations until it's paid in full. I'm searching now if forging my signature puts the administrator in contempt. If so then the contempt is ongoing. So I've read. And to this very day. By forging my name he unknowingly kept the case open. In contempt. Stay or not. Therefore I'm filing abstract of judgement unsatisfied. To get my writ of execution issued with my initial paperwork to pass to the sister state he is in for the sheriff to deliver and he will receive notification of liens.

Say a Trustee is also a Beneficiary. There is Real Estate in the Trust called a Vacation Share, to be used by the Beneficiaries. The Trustee wants to use this RE, the other Beneficiaries do not, and want to sell and distribute. Can the Trustee force the Trust to hold the property indefinitely (and use at their own will)?

Typically, no the trustee cannot do so. However, it does depend on the trust terms. The best bet for the beneficiaries is if the trust requires every beneficiary to receive their shares "outright and free of trust." That language means the real property must either be sold and the proceeds distributed, or the deed title of the property must be passed out to the beneficiaries. Once in the beneficiaries hands, they can force a sale through a partition action. There are other trust terms that could help. You should sit down with a competent trust lawyer to go over the trust and provide you with your viable options.
